Bajalah says: Sayyiduna Umar bin Khattab (may Allah be pleased with him) did not take jizya from the Magians, until Sayyiduna Abdur Rahman bin Awf (may Allah be pleased with him) testified that the Noble Prophet (peace and blessings be upon him) had taken it from the Magians living in the area called "Hajr."

Explanation & Benefits

Benefit: If there are dhimmi disbelievers in the lands of the Muslims, then it is permissible to take jizyah from them. Sometimes, when Sayyiduna Umar radi Allahu anhu would hear a new hadith, he would ask the one narrating it to bring a witness. If the narrator presented a witness, he would accept the hadith. He was very diligent in verifying hadith. This does not entail any criticism of the integrity of the noble Companions radi Allahu anhum ajma'in, because all of them were upright and truthful. Sayyiduna Umar radi Allahu anhu acted out of caution. For the purpose of verifying a hadith, he would occasionally request a witness, especially when he was hearing the hadith for the first time. Through this action, he intended to teach the noble Companions radi Allahu anhum and the Muslim Ummah that attributing an unverified statement to the Noble Prophet sallallahu alayhi wa sallam is an addition to the religion, which is forbidden and a major sin.
