Sayyiduna Abdullah bin Amr (may Allah be pleased with him) narrates: A man found a treasure, so regarding it the Prophet Muhammad (peace and blessings be upon him) said: "If you found it in a residential area, then you should keep announcing it. But if you found it in the ruins of the pre-Islamic era, or in a non-residential area, or on a path away from the common thoroughfare, then in that case, payment of 'khums' (one-fifth) will be obligatory on it, just as it is on 'rikaz' (buried treasure)."

Benefit: The first issue mentioned in this hadith is that if a valuable item is found lying on a populated pathway, it should be announced for one year. If its owner is found, it should be returned to him; but if the owner is not found, then the person who found it becomes its owner.
The second issue is that if something is found in a deserted place or if a buried item is found, then one-fifth of it should be deposited in the public treasury (Bayt al-Mal) or distributed among the poor and others, and the remainder may be used by the finder.
