Hadith 608

608 - حَدَّثَنَا الْحُمَيْدِيُّ قَالَ: ثنا سُفْيَانُ، قَالَ: سَمِعْنَاهُ مِنْ دَاوُدَ بْنِ شَابُورَ، وَيَعْقُوبَ بْنِ عَطَاءٍ، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ عَبْدِ اللَّهِ بْنِ عَمْرٍو، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّي اللهُ عَلَيْهِ وَسَلَّمَ فِي كَنْزٍ وَجَدَهُ رَجُلٌ: «إِنْ كُنْتَ وَجَدْتَهُ فِي قَرْيَةٍ مَسْكُونَةٍ، أَوْ فِي سَبِيلٍ مَيْتَاءَ فَعَرِّفْهُ، وَإِنْ كُنْتَ وَجَدْتَهُ فِي خَرِبَةٍ جَاهِلِيَّةٍ، أَوْ فِي قَرْيَةٍ غَيْرِ مَسْكُونَةٍ، أَوْ غَيْرِ سَبِيلِ مَيْتَاءَ فَفِيهِ، وَفِي الرِّكَازِ الْخُمْسُ»
Sayyiduna Abdullah bin Amr (may Allah be pleased with him) narrates: A man found a treasure, so regarding it the Prophet Muhammad (peace and blessings be upon him) said: "If you found it in a residential area, then you should keep announcing it. But if you found it in the ruins of the pre-Islamic era, or in a non-residential area, or on a path away from the common thoroughfare, then in that case, payment of 'khums' (one-fifth) will be obligatory on it, just as it is on 'rikaz' (buried treasure)."

Benefit:
The first issue mentioned in this hadith is that if a valuable item is found lying on a populated pathway, it should be announced for one year. If its owner is found, it should be returned to him; but if the owner is not found, then the person who found it becomes its owner.

The second issue is that if something is found in a deserted place or if a buried item is found, then one-fifth of it should be deposited in the public treasury (Bayt al-Mal) or distributed among the poor and others, and the remainder may be used by the finder.
