410 - حَدَّثَنَا الْحُمَيْدِيُّ قَالَ: ثنا سُفْيَانُ قَالَ: ثنا يَحْيَي بْنُ سَعِيدٍ قَالَ: أَخْبَرَنِي حَنْظَلَةُ بْنُ قَيْسٍ الزُّرَقِيُّ أَنَّهُ سَمِعَ رَافِعَ بْنَ خَدِيجٍ يَقُولُ: «كُنَّا أَكْثَرَ الْأَنْصَارِ حَقْلًا وَكُنَّا نَقُولُ لِلَّذِي نُخَابِرُهُ لَكَ هَذِهِ الْقِطْعَةُ وَلَنَا هَذِهِ الْقِطْعَةُ يَزْرَعُهَا لَنَا فَرُبَّمَا أَخْرَجَتْ هَذِهِ وَلَمْ تُخْرِجْ هَذِهِ» فَنَهَانَا رَسُولُ اللَّهِ صَلَّي اللهُ عَلَيْهِ وَسَلَّمَ عَنْ ذَلِكَ فَأَمَّا بِوَرِقٍ فَلَمْ يَنْهَنَا " فَقِيلَ لِسُفْيَانَ: فَإِنَّ مَالِكًا يَرْوِيهِ عَنْ رَبِيعَةَ، عَنْ حَنْظَلَةَ وَمَا كَانَ يَرْجُو أَنَّهُ إِذَا كَانَ عِنْدَ يَحْيَي وَيَحْيَي أَحْفَظُهُمَا لَكِنَّا حَفِظْنَاهُ مِنْ يَحْيَي
Sayyiduna Rafi’ bin Khadij (may Allah be pleased with him) narrates: Among the Ansar, we had the most fields. When we used to give land to someone on contract, we would tell him, “You will get this part, and the produce of this part will be ours.” Sometimes there would be produce in this part and not in the other. So the Noble Prophet (peace and blessings be upon him) forbade us from this. As for giving land on contract in exchange for silver, the Noble Prophet (peace and blessings be upon him) did not forbid us from this. Sufyan was told: Imam Malik has narrated this report from Hanzalah, on the authority of Rabi’ah. He replied: When it can be obtained from Yahya, then there is no need for anyone else, because Yahya is more cautious, and we have preserved this narration after hearing it from Yahya.
