Ubaydullah bin Abu Yazid narrates: My father told me that once Sayyiduna Umar bin Khattab (may Allah be pleased with him) sent a message to an elder from Banu Zuhrah and called him; he used to live in our neighborhood and had witnessed the era of ignorance. I went with that elder to Sayyiduna Umar bin Khattab (may Allah be pleased with him). Sayyiduna Umar bin Khattab (may Allah be pleased with him) was present in the Hatim at that time. Sayyiduna Umar bin Khattab (may Allah be pleased with him) asked him about (illegitimate children) born in the era of ignorance. The elder replied: As far as the sperm is concerned, it belonged to such-and-such person, and as for the birth, it happened on the bed of such-and-such person. So Sayyiduna Umar bin Khattab (may Allah be pleased with him) said: You have spoken the truth, but the Noble Prophet (peace and blessings be upon him) has given the decision in favor of the bed (i.e., the child belongs to the owner of the bed). When that elderly person turned back, Sayyiduna Umar bin Khattab (may Allah be pleased with him) called him and asked: Tell me about the construction of the Ka'bah? He replied: The Quraysh wanted to earn virtue by constructing the Ka'bah, but they were unable to complete it; their (resources) became scarce, so they left out a part of the Hatim area. So Sayyiduna Umar bin Khattab (may Allah be pleased with him) said: You have spoken the truth.

Benefit: Sometimes, Sayyiduna Umar radi Allahu anhu would call elderly people, who had witnessed the era of ignorance (Jahiliyyah), and ask them various questions. Some old men are very wise and intelligent; their words are adorned with the experiences of life. If one finds an elderly person, one should converse with him, because he has seen an era with his own eyes. The answer the old man gave to the first question, Sayyiduna Umar radi Allahu anhu responded to it by narrating the hadith that the Noble Prophet sallallahu alayhi wa sallam decreed (regarding a child born from the sperm of someone other than the husband) that the child belongs to the owner of the bed.
In this hadith, “owner of the bed” refers to the woman’s husband or the owner of a slave woman. The child will be counted as belonging to the household in which he was born, and he will have an equal right to inheritance. The child will have no relation to the man who committed adultery.
In another hadith, it is narrated from Sayyiduna Abu Hurairah radi Allahu anhu that the Messenger of Allah sallallahu alayhi wa sallam said: “Al-waladu lil-firash wa lil-‘ahiri al-hajar” — “The child is for the owner of the bed, and for the adulterer is the stone (i.e., the adulterer will be stoned).” (Sahih Muslim: 1458) The answer the old man gave to the second question, that the Hatim was left out because the wealth of Quraysh of Makkah had run out, its details are present in Sahih al-Bukhari (1584).
