223 - ثنا سُفْيَانُ قَالَ: ثنا عَبْدُ اللَّهِ بْنُ أَبِي بَكْرِ بْنِ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ، عَنْ أَبِيهِ، عَنْ عَمْرَةَ أَنَّهَا سَمِعَتْ عَائِشَةَ تَقُولُ: إِنَّمَا قَالَ رَسُولُ اللَّهِ صَلَّي اللهُ عَلَيْهِ وَسَلَّمَ لِيَهُودِيَّةٍ وَهُمْ يَبْكُونَ عَلَيْهَا «إِنَّ أَهْلَهَا الْآنَ لَيَبْكُونَ عَلَيْهَا وَإِنَّهَا لَتُعَذَّبُ فِي قَبْرِهَا»
Umm al-Mu'mineen Sayyidah Aisha (may Allah be pleased with her) narrates: The Noble Prophet (peace and blessings be upon him) said about a Jewish woman, while her family was weeping over her, (he said:) "At this moment her family is weeping over her and she is being punished in her grave."

From this hadith, the proof of the punishment of the grave is established. The disbeliever (kafir) will receive the punishment of the grave due to his disbelief, and he will also receive the punishment of the grave because of the weeping and wailing of his family over his corpse. According to the Qur'an and hadith, all humans are legally responsible (mukallaf), whether they are Muslims or disbelievers.
