1331 - حَدَّثَنَا الْحُمَيْدِيُّ قَالَ: ثنا سُفْيَانُ، قَالَ: ثنا مُجَالِدُ بْنُ سَعِيدٍ الْهَمْدَانِيُّ، عَنِ الشَّعْبِيِّ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، قَالَ: زَنَي رَجُلٌ مِنْ أَهْلِ فَدَكٍ، فَكَتَبَ أَهْلُ فَدَكٍ إِلَي أُنَاسٍ مِنَ الْيَهُودِ بِالْمَدِينَةِ، أَنْ سَلُوا مُحَمَّدًا عَنْ ذَلِكَ، فَإِنْ أَمَرَكُمْ بِالْجَلْدِ، فَخُذُوهُ عَنْهُ، وَإِنْ أَمَرَكُمْ بِالرَّجْمِ، فَلَا تَأْخُذُوهُ عَنْهُ، فَسَأَلُوهُ عَنْ ذَلِكَ، فَقَالَ: «أَرْسِلُوا إِلَيَّ أَعْلَمَ رَجُلَيْنِ فِيكُمْ» ، فَجَاءُوا بِرَجُلٍ أَعْوَرَ يُقَالُ لَهُ ابِنُ صُورِيَّا، وَآخَرَ، فَقَالَ لَهُمَا النَّبِيُّ صَلَّي اللهُ عَلَيْهِ وَسَلَّمَ: «أَنْتُمَا أَعْلَمُ مَنْ قِبَلَكُمَا؟»، فَقَالَا: قَدْ نَحَّانَا قَوْمُنَا لِذَلِكَ، فَقَالَ النَّبِيُّ صَلَّي اللهُ عَلَيْهِ وَسَلَّمَ لَهُمَا: «أَلَيْسَ عِنْدَكُمَا التَّوْرَاةُ فِيهَا حُكْمُ اللَّهِ تَعَالَي؟» ، قَالَا: بَلَي، فَقَالَ النَّبِيُّ صَلَّي اللهُ عَلَيْهِ وَسَلَّمَ: «فَأُنْشِدُكُمْ بَالَّذِي فَلَقَ الْبَحْرَ لِبَنِي إِسْرَائِيلَ، وَظَلَّلَ عَلَيْكُمُ الْغَمَامَ، وَأَنْجَاكُمْ مِنْ آلِ فِرْعَوْنَ، وَأَنْزَلَ الْمَنَّ وَالسَّلْوَي عَلَي بَنِي إِسْرَائِيلَ، مَا تَجِدُونَ فِي التَّوْرَاةِ مِنْ شَأْنِ الرَّجْمِ؟» ، فَقَالَ أَحَدُهُمَا لِلْآخَرِ: مَا نُشِدْتُ بِمِثْلِهِ قَطُّ، ثُمَّ قَالَا: نَجِدُ تَرْدَادَ النَّظَرِ زَنْيَةً، وَالِاعْتِنَاقَ زَنْيَةً، وَالْقُبَلُ زَنْيَةً، فَإِذَا أَشْهَدَ أَرْبَعَةً أَنَّهُمْ رَأَوْهُ يُبِدِي وَيُعِيدُ كَمَا يَدْخُلُ الْمِيلُ فِي الْمِكْحَلَةِ، فَقَدْ وَجَبَ الرَّجْمُ، فَقَالَ النَّبِيُّ صَلَّي اللهُ عَلَيْهِ وَسَلَّمَ: «هُوَ ذَاكَ فَأَمَرَ بِهِ» ، فَرُجِمَ، فَنَزَلَتْ: ﴿ فَإِنْ جَاءُوكَ فَاحْكُمْ بَيْنَهُمْ أَوْ أَعْرِضْ عَنْهُمْ وَإِنْ تُعْرِضْ عَنْهُمْ فَلَنْ يَضُرُّوكَ شَيْئًا وَإِنْ حَكَمْتَ فَاحْكُمْ بَيْنَهُمْ بِالْقِسْطِ﴾ الْآيَةَ
Sayyiduna Jabir bin Abdullah (may Allah be pleased with him) narrates: A man from Fadak committed adultery, so the people of Fadak wrote a letter to some Jews living in Madinah Munawwarah, asking them to inquire from Sayyiduna Muhammad (peace be upon him) about this matter. If he orders flogging, then accept it, but if he orders stoning, then do not accept it. Those people asked the Prophet (peace be upon him) about this matter, so the Prophet (peace be upon him) said: "Send to me two of your most knowledgeable men." So they brought a one-eyed man whose name was "Surya" and another man. The Prophet (peace be upon him) asked both of them: "Are you two the most knowledgeable among you?" They replied: Our people have presented us before you for this very reason. The Prophet (peace be upon him) asked them: "Do you not have the command of Allah in the Torah?" They replied: Yes, we do. The Prophet (peace be upon him) said: "Then I ask you by the One who parted the sea for the Children of Israel, who shaded you with clouds, who saved you from Pharaoh and his companions, and who sent down manna and quails upon the Children of Israel—what do you find in the Torah regarding stoning?" One of them said to the other: I have never been asked to swear such an oath. Then both replied: Repeating the act is also adultery, embracing is also adultery, kissing is also adultery, and if four men testify that they saw a man committing adultery in the manner that a needle enters a kohl container, then stoning becomes obligatory. The Prophet (peace be upon him) said: "That is it." Then, by the order of the Prophet (peace be upon him), that man was stoned. Then this verse was revealed: «فَإِنْ جَاءُوكَ فَاحْكُمْ بَيْنَهُمْ أَوْ أَعْرِضْ عَنْهُمْ وَإِنْ تُعْرِضْ عَنْهُمْ فَلَنْ يَضُرُّوكَ شَيْئًا وَإِنْ حَكَمْتَ فَاحْكُمْ بَيْنَهُمْ بِالْقِسْطِ» (5-al-Ma'idah:42) "If they come to you, judge between them or turn away from them. If you turn away from them, they will not harm you at all. But if you judge, judge between them with justice."

Benefit:
It is established from this hadith that the Jews would also bring some of their issues to be resolved by the Messenger of Allah (sallallahu alayhi wa sallam), and they would appoint the Noble Prophet (sallallahu alayhi wa sallam) as their arbitrator. However, at times, they would attempt to obtain a verdict that suited their desires but the Prophet (sallallahu alayhi wa sallam) would issue verdicts in accordance with the Qur’an and Hadith.
Whenever one needs to speak with an opposing party, one should speak with their scholars, not with the ignorant, because Allah, the Exalted, has commanded to turn away from the ignorant. (: al-A'raf: 199)
The Jews, as part of a failed plot, would bring their cases to the blessed court of the Prophet (sallallahu alayhi wa sallam), but he (sallallahu alayhi wa sallam) made them confess from their own book and through the words of their own scholars, and the married adulterer was stoned.
From here, an important principle of debate is understood: that the matter should be established from the opponent’s own book, and then the opponent’s scholars should be made to acknowledge it. This is the most effective form of debate. All the Prophets (alayhim as-salam) always judged with justice.

Regarding the Jewish man and woman who had committed adultery, in some of the aforementioned narrations it is mentioned that, concerning their punishment, they first came to the Messenger of Allah (sallallahu alayhi wa sallam), and the Messenger of Allah asked them about the punishment for adultery.
In explanation of this, it has been said that either these are two separate incidents, or they themselves immediately carried out the punishment on their own, and then later, when they passed by the Messenger of Allah (sallallahu alayhi wa sallam), the questions and answers took place.

➊ Some researchers have declared the mentioned narration to be authentic. In the religions of the Jews and Christians as well, taking a false oath is forbidden; therefore, when necessary, an oath can be taken from them.
➋ An oath should be taken by Allah alone, even from non-Muslims.
➌ The Jews respect the Torah and claim to have faith in it; therefore, an oath can be taken from them according to their belief, but with such words that are not contrary to Islamic creed either.
