Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates: I presented myself before the Prophet Muhammad (peace and blessings be upon him) and his companions after the conquest of Khaybar. I requested the Prophet (peace be upon him): "Please grant me something from the spoils of war." Then a person from Banu Sa'id bin As intervened and said to the Prophet (peace be upon him): "O Messenger of Allah! Do not give him a share." I said: "O Messenger of Allah! He is the killer of Ibn Qawqal." Then Ibn Sa'id said: "It is astonishing about this cat, who has come down from the mountain and is now informing against me about the killing of such a Muslim, whom Allah honored at my hands and did not disgrace me at his hands." Sufyan says: I do not know whether the Prophet (peace be upon him) gave him a share or did not give him a share.

Abu Hurairah said “I came to Madeenah when the Abu Messenger of Allah ﷺ was in Khaibar, after it was captured. I asked him to give me a share from the booty. A son of Saeed bin Al ‘As spoke and said “Do not give him any share, Messenger of Allah ﷺ. I said “This is the killer of Ibn Qauqal. ” (The son of) Saeed bin Al ‘As said “Oh, how wonderful! A Wabr who came down to us from the peak of Dal blames me of having killed a Muslim whom Allaah honored at my hands and did not disgrace me at his hands. Abu Dawud said “They were about ten persons. Six of them were killed and the remaining returned.

Benefits and Issues: ➊ Those people who do not participate in the battle in any way do not have a formal share in the spoils of war (ghanimah). However, Imam Abu Hanifah rahimahullah states that those who join the Muslim army after the spoils have been collected, but before they have been distributed, will also receive a share from them.
➋ Ibn Qawqal (Nu'man bin Qawqal radi Allahu anhu) was an Ansari Companion who was martyred at the Battle of Uhud at the hands of Aban bin Sa'id. Whereas Aban accepted Islam after Hudaybiyyah, and the Battle of Khaybar took place after Hudaybiyyah.
➌ In the first narration, it is mentioned that Aban bin Sa'id made a claim for the spoils of war, but Abu Hurairah radi Allahu anhu refused. In the second narration, it is mentioned that Abu Hurairah radi Allahu anhu made the request, but Aban refused. Hafiz Mundhiri, referencing Abu Bakr al-Khatib rahimahullah, has considered the second narration to be more correct.
