حَدِیث رِجَال یَتَحَدَّثونَ
Hadith of men who were conversing
Hadith 16619
(حديث مرفوع) حَدَّثَنَا يَحْيَى بْنُ إِسْحَاقَ ، قَالَ : حَدَّثَنَا ابْنُ لَهِيعَةَ ، عَنْ عُبَيْدِ اللَّهِ بْنِ أَبِي جَعْفَرٍ ، عَنْ الْفَضْلِ بْنِ عَمْرِو بْنِ أُمَيَّةَ ، عَنْ أَبِيهِ ، قَالَ : سَمِعْتُ رِجَالًا يَتَحَدَّثُونَ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَنَّهُ قَالَ : " إِذَا أُعْتِقَتِ الْأَمَةُ ، فَهِيَ بِالْخِيَارِ مَا لَمْ يَطَأْهَا ، إِنْ شَاءَتْ فَارَقَتْهُ ، وَإِنْ وَطِئَهَا فَلَا خِيَارَ لَهَا ، وَلَا تَسْتَطِيعُ فِرَاقَهُ " .
It is narrated from several Companions (may Allah be pleased with them) that the Prophet (peace and blessings be upon him) said: When a slave woman is granted her freedom, she is given the choice, provided that her husband has not had intercourse with her; if she wishes, she may separate from her husband. But if he has had intercourse with her, then she no longer has this choice and separation cannot take place.
Hadith 16620
(حديث مرفوع) حَدَّثَنَا حَسَنٌ ، قَالَ : حَدَّثَنَا ابْنُ لَهِيعَةَ ، قَالَ : حَدَّثَنَا عُبَيْدُ اللَّهِ ابْنُ جَعْفَرٍ ، عَنِ الْفَضْلِ بْنِ الْحَسَنِ بْنِ عَمْرِو بْنِ أُمَيَّةَ الضَّمْرِيِّ ، قَالَ : سَمِعْتُ رِجَالًا مِنْ أَصْحَابِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَتَحَدَّثُونَ ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " إِذَا أُعْتِقَتْ الْأَمَةُ وَهِيَ تَحْتَ الْعَبْدِ ، فَأَمْرُهَا بِيَدِهَا ، فَإِنْ هِيَ أَقَرَّتْ حَتَّى يَطَأَهَا ، فَهِيَ امْرَأَتُهُ لَا تَسْتَطِيعُ فِرَاقَهُ " .
