حَدِيثُ الضَّحَّاكِ بْنِ سُفْيَانَ رَضِيَ اللَّهُ تَعَالَى عَنْهُ
Hadith of al-Dahhak ibn Sufyan (may Allah be pleased with him)
Hadith 15745
(حديث مرفوع) حَدَّثَنَا عَبْدُ الرَّزَّاقِ ، حَدَّثَنَا مَعْمَرٌ ، عَنِ الزُّهْرِيِّ ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ تَعَالَى عَنْهُ ، قَالَ : مَا أَرَى الدِّيَةَ إِلَّا لِلْعَصَبَةِ ، لِأَنَّهُمْ يَعْقِلُونَ عَنْهُ ، فَهَلْ سَمِعَ أَحَدٌ مِنْكُمْ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي ذَلِكَ شَيْئًا ؟ فَقَالَ : الضَّحَّاكُ بْنُ سُفْيَانَ الْكِلَابِيُّ ، وَكَانَ اسْتَعْمَلَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَى الْأَعْرَابِ : كَتَبَ إِلَيَّ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ " أُوَرِّثَ امْرَأَةَ أَشْيَمَ الضَّبَابِيِّ مِنْ دِيَةِ زَوْجِهَا " , فَأَخَذَ بِذَلِكَ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللَّهُ تَعَالَى عَنْهُ .
Saeed bin Musayyib says that once Sayyiduna Umar said: "I think that the blood money (diyah) should be given to the 'asaba (male agnates), because they are his family. Has anyone among you heard the Prophet (peace be upon him) say anything about this?" Upon this, Sayyiduna Dahiq, whom the Prophet (peace be upon him) had appointed as an official over the Bedouins, said: "The Prophet (peace be upon him) wrote to me in a letter that I should consider the wife of Ashim Dhababi as an heir in her husband's blood money." And upon this, Sayyiduna Umar began to act according to this hadith.
Hadith 15746
(حديث مرفوع) حَدَّثَنَا سُفْيَانُ ، قَالَ : سَمِعْتُهُ مِنَ الزُّهْرِيِّ ، عَنْ سَعِيدٍ ، أَنَّ عُمَرَ ، قَالَ : الدِّيَةُ لِلْعَاقِلَةِ ، وَلَا تَرِثُ الْمَرْأَةُ مِنْ دِيَةِ زَوْجِهَا ، حَتَّى أَخْبَرَهُ الضَّحَّاكُ بْنُ سُفْيَانَ الْكِلَابِيُّ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَتَبَ إِلَيَّ أَنْ " أُوَرِّثَ امْرَأَةَ أَشْيَمَ الضَّبَابِيِّ مِنْ دِيَةِ زَوْجِهَا " ، فَرَجَعَ عُمَرُ عَنْ قَوْلِهِ .
Saeed bin Musayyib says that the opinion of Sayyiduna Umar was that only the 'asaba (male agnates) should receive the blood money (diyah), and a woman should not inherit from her husband's blood money, until Sayyiduna Dahhak bin Sufyan informed him that the Prophet (ﷺ) wrote to me in a letter: that I should consider the wife of Ashyam Dhibabi as an heir in her husband's blood money. Upon this, Sayyiduna Umar withdrew his opinion.
Hadith 15747
(حديث مرفوع) حَدَّثَنَا أَحْمَدُ بْنُ عَبْدِ الْمَلِكِ ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ ، عَنْ عَلِيِّ بْنِ جُدْعَانَ ، عَنِ الْحَسَنِ ، عَنِ الضَّحَّاكِ بْنِ سُفْيَانَ الْكِلَابِيِّ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ لَهُ : " يَا ضَحَّاكُ ، مَا طَعَامُكَ ؟ " , قَالَ : يَا رَسُولَ اللَّهِ ، اللَّحْمُ وَاللَّبَنُ , قَالَ : " ثُمَّ يَصِيرُ إِلَى مَاذَا ؟ " , قَالَ : إِلَى مَا قَدْ عَلِمْتَ , قَالَ : " فَإِنَّ اللَّهَ تَبَارَكَ وَتَعَالَى ضَرَبَ مَا يَخْرُجُ مِنَ ابْنِ آدَمَ مَثَلًا لِلدُّنْيَا " .
It is narrated from Sayyiduna Duhak bin Sufyan that once a man from the tribe of Kilab asked him, "Duhak, what is your food?" He replied, "O Messenger of Allah! Meat and milk." The Prophet (peace and blessings be upon him) asked, "What does meat and milk become afterwards?" He replied, "You know that best." The Prophet (peace and blessings be upon him) said, "Allah has made the filth that comes out of the body of the son of Adam an example of this world."
