Hadith of Salamah bint Ma'qil (may Allah be pleased with her)
Hadith 27029
حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ الرَّازِيُّ ، قَالَ : حَدَّثَنَا سَلَمَةُ بْنُ الْفَضْلِ ، قَالَ : حَدَّثَنِي مُحَمَّدُ بْنُ إِسْحَاقَ ، عَنِ الْخَطَّابِ بْنِ صَالِحٍ ، عَنْ أُمِّهِ ، قَالَتْ : حَدَّثَتْنِي سَلَامَةُ بِنْتُ مَعْقِلٍ ، قَالَتْ : كُنْتُ لِلْحُبَابِ بْنِ عَمْرٍو ، وَلِي مِنْهُ غُلَامٌ ، فَقَالَتْ لِيَ امْرَأَتُهُ : الْآنَ تُبَاعِينَ فِي دَيْنِهِ ، فَأَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَذَكَرْتُ ذَلِكَ لَهُ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنْ صَاحِبُ تَرِكَةِ الْحُبَابِ بْنِ عَمْرٍو ؟ " فَقَالُوا : أَخُوهُ أَبُو الْيُسْرِ كَعْبُ بْنُ عَمْرٍو ، فَدَعَاهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : " لَا تَبِيعُوهَا ، وَأَعْتِقُوهَا ، فَإِذَا سَمِعْتُمْ بِرَقِيقٍ قَدْ حَسَبَنِي ، فَأْتُونِي أُعَوِّضُكُمْ " , فَفَعَلُوا ، فَاخْتَلَفُوا فِيمَا بَيْنَهُمْ بَعْدَ وَفَاةِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ قَوْمٌ أُمُّ الْوَلَدِ مَمْلُوكَةٌ : لَوْلَا ذَلِكَ لَمْ يُعَوِّضْهُمْ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْهَا ، وَقَالَ بَعْضُهُمْ : هِيَ حُرَّةٌ , قَدْ أَعْتَقَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ . فَفِيَّ كَانَ الِاخْتِلَافُ.
It is narrated from Hazrat Salamah bint Ma’qil (may Allah be pleased with her) that I was in the slavery of Hubab bin Amr, and a boy was also born to me from him. Upon his death, his wife told me that now you will be sold in exchange for Hubab’s debts. I went to the service of the Prophet (peace and blessings be upon him) and mentioned this incident. The Prophet (peace and blessings be upon him) asked the people, “Who is responsible for the inheritance of Hubab bin Amr?” The people informed that his brother Abu al-Yasar Ka’b bin Amr is. The Prophet (peace and blessings be upon him) called him and said: “Do not sell her, rather set her free, and when you hear that a slave has come to me, then come to me and I will give you another slave in exchange for her.” And so it happened. But after the passing of the Prophet (peace and blessings be upon him), a difference of opinion arose among the noble Companions (may Allah be pleased with them). Some people were of the opinion that an umm walad is a slave; if she were not property, why would the Prophet (peace and blessings be upon him) give compensation for her? And some people were of the opinion that she is free because the Prophet (peace and blessings be upon him) set her free. This difference of opinion was regarding me.
