Hadith 24009/37
Yaqoob narrated to us, Abdul Aziz ibn Al-Muttalib informed us, from Saeed ibn Amr ibn Shurahbeel, from his grandfather, that he said: A book I found among the books of Saeed ibn Saad ibn Ubadah, that Umara ibn Hazm testified: That the Messenger of Allah, peace and blessings be upon him, "ruled with an oath along with a witness." Zayd ibn Al-Hubab said: I asked Malik ibn Anas about the oath and the witness: Is it permissible in divorce and emancipation? He said: No, this is only in buying, selling, and the like.

حسنٌ ، حدثنا
ابن لَهِيعةَ ، حدثنا
بَكْرُ بن سَوَادةَ ، عن
زياد بن نُعَيم الحَضْرميِّ ، عن
عُمارةَ بن حَزْم ، قال : رآني رسول الله صَلَّي اللهُ عَلَيْهِ وَسَلَّمِ جالسًا على قَبْرٍ . . وقال في موضعٍ آخر : زياد بن نُعيم ، أَن ابنَ حَزْمٍ إِما عمرو ، وإِما عُمارة ، قال : رآني رسول الله صَلَّي اللهُ عَلَيْهِ وَسَلَّمِ وأَنا مُتَّكِئٌ على قَبْرٍ ، فقال :
" انزِلْ من القبرِ ، لا تُؤْذِي صاحبَ القبر ، ولا يُؤْذِيك "
Hassan narrated to us, Ibn Lahi'ah narrated to us, Bakr ibn Sawadah narrated to us, from Ziyad ibn Nu'aym al-Hadrami, from 'Umara ibn Hazm, who said: The Messenger of Allah, peace and blessings be upon him, saw me sitting on a grave... And in another place he said: Ziyad ibn Nu'aym, that the son of Hazm was either 'Amr or 'Umara, who said: The Messenger of Allah, peace and blessings be upon him, saw me while I was reclining on a grave, and he said: "Get down from the grave, do not harm the occupant of the grave, and he will not harm you."
