Hadith 20748
حَدَّثَنَا
أَزْهَرُ بْنُ الْقَاسِمِ ، حَدَّثَنَا
مُحَمَّدُ بْنُ ثَابِتٍ ، عَنْ
أَبِي عِمْرَانَ الْجَوْنِيِّ ، قَالَ : حَدَّثَنِي
بَعْضُ أَصْحَابِ مُحَمَّدٍ ، وَغَزَوْنَا نَحْوَ فَارِسَ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :
" مَنْ بَاتَ فَوْقَ بَيْتٍ لَيْسَ لَهُ إِجَّارٌ فَوَقَعَ فَمَاتَ ، فَبَرِئَتْ مِنْهُ الذِّمَّةُ ، وَمَنْ رَكِبَ الْبَحْرَ عِنْدَ ارْتِجَاجِهِ فَمَاتَ ، فَقَدْ بَرِئَتْ مِنْهُ الذِّمَّةُ " .
It is narrated from a companion that the Prophet (peace and blessings be upon him) said: Whoever sleeps on the roof of a house that has no parapet, and he falls from it, then no one is responsible for him. And whoever sets out on a sea journey at a time when the sea is turbulent and he dies, then no one is responsible for him either.
