Hadith 17539
حَدَّثَنَا
مُحَمَّدُ بْنُ جَعْفَرٍ ، حَدَّثَنَا
سَعِيدُ بْنُ أَبِي عَرُوبَةَ ، عَنْ
قَتَادَةَ ، عَنْ
يَعْلَى بْنِ حَكِيمٍ ، عَنْ
سُلَيْمَانَ بْنِ يَسَارٍ ، عن
رَافِعِ بْنِ خَدِيجٍ ، قَالَ : كُنَّا نُحَاقِلُ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَى الثُّلُثِ ، وَالرُّبُعِ ، أَوْ طَعَامٍ مُسَمًّى ، قَالَ : فَأَتَانَا
بَعْضُ عُمُومَتِي ، فَقَالَ : نَهَانَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، عن أَمْرٍ كَانَ لَنَا نَافِعًا ، وَطَوَاعِيَةُ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَرْفَعُ لَنَا وَأَنْفَعُ . قَالَ : قُلْنَا : وَمَا ذَاكَ ؟ قَالَ : قَالَ نَبِيُّ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :
" مَنْ كَانَتْ لَهُ أَرْضٌ فَلْيَزْرَعْهَا ، أَوْ لِيُزْرِعْهَا أَخَاهُ وَلَا يُكَارهَا بِثُلُثٍ ، وَلَا رُبُعٍ ، وَلَا بِطَعَامٍ مُسَمًّى " . قَالَ قَتَادَةُ : وَهُوَ ظَهِيرٌ.
It is narrated from Hazrat Rafi’ (may Allah be pleased with him) that during the blessed era of the Prophet (peace and blessings be upon him), we used to give land on sharecropping for one-third, one-fourth, or a fixed portion of the crop as rent. But one day, one of my uncles came to me and said that the Prophet (peace and blessings be upon him) has forbidden us from an act that was beneficial for us, but obedience to Allah and His Messenger is more beneficial. The Prophet (peace and blessings be upon him) forbade us from giving land on sharecropping and from renting it out for one-third, one-fourth, or a fixed portion of the crop, and he instructed the owner of the land to either cultivate it himself or permit someone else to do so, but he disliked rent and other such arrangements. Qatadah says that his uncle was Hazrat Zuhair (may Allah be pleased with him).
