(حديث مرفوع) حَدَّثَنَا
عَفَّانُ ، حَدَّثَنَا
حَمَّادُ بْنُ سَلَمَةَ ، أخبرنا
الْحَجَّاجُ ، عَنِ
الْحَسَنِ بْنِ سَعْدٍ ، عَنْ
أَبِيهِ ، أَنَّ يُحَنَّسَ وَصَفِيَّةَ كَانَا مِنْ سَبْيِ الْخُمُسِ ، فَزَنَتْ صَفِيَّةُ بِرَجُلٍ مِنَ الْخُمُسِ ، فَوَلَدَتْ غُلَامًا فَادَّعَاهُ الزَّانِي وَيُحَنَّسُ ، فَاخْتَصَمَا إِلَى عُثْمَانَ بن عفان ، فَرَفَعَهُمَا إِلَى عَلِيِّ بْنِ أَبِي طَالِبٍ ، فَقَالَ
عَلِيٌّ : أَقْضِي فِيهِمَا بِقَضَاءِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " الْوَلَدُ لِلْفِرَاشِ ، وَلِلْعَاهِرِ الْحَجَرُ " ، وَجَلَدَهُمَا خَمْسِينَ خَمْسِينَ .
Sa’d (may Allah have mercy on him) says that Yuhnas and Safiyyah were both among the captives of the khums. Safiyyah committed adultery with another man from the khums and gave birth to a child. Both the adulterer and Yuhnas claimed the child, and they brought their case before Sayyiduna ‘Uthman Ghani (may Allah be pleased with him). He sent both of them to Sayyiduna ‘Ali (may Allah be pleased with him). Sayyiduna ‘Ali (may Allah be pleased with him) said: “I will judge between you as the Prophet (peace and blessings be upon him) judged, and that is: the child belongs to the owner of the bed, and for the adulterer there are stones.” Then he gave both of them fifty lashes each.
