(حديث مرفوع) حَدَّثَنَا أَبُو سَعِيدٍ مَوْلَى بَنِي هَاشِمٍ ، حَدَّثَنَا مُحَمَّدُ بْنُ رَاشِدٍ ، حَدَّثَنَا سُلَيْمَانُ بْنُ مُوسَى ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " عَقْلُ شِبْهِ الْعَمْدِ مُغَلَّظَةٌ ، مِثْلُ عَقْلِ الْعَمْدِ ، وَلَا يُقْتَلُ صَاحِبُهُ ، وَمَنْ حَمَلَ عَلَيْنَا السِّلَاحَ فَلَيْسَ مِنَّا ، وَلَا رَصَدَ بِطَرِيقٍ " .
It is narrated from Sayyiduna Ibn Amr (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "The blood money (diyah) for accidental killing resembling intentional murder (shibh ‘amd) is aggravated, just as the blood money for intentional murder (‘amd) is, except that in shibh ‘amd the killer will not be killed. And whoever raises arms against us or lies in wait on the road is not one of us."
