Hadith 707

(حديث موقوف) حَدَّثَنَا حَدَّثَنَا يَعْقُوبُ ، حَدَّثَنَا أَبِي ، عَنِ ابْنِ إِسْحَاقَ ، حَدَّثَنِي يَحْيَى بْنُ عَبَّادِ بْنِ عَبْدِ اللَّهِ بْنِ الزُّبَيْرِ ، عَنْ أَبِيهِ ، عَنْ عَبْدِ اللَّهِ بْنِ الزُّبَيْرِ ، قَالَ : وَاللَّهِ إِنَّا لَمَعَ عُثْمَانَ بْنِ عَفَّانَ بِالْجُحْفَةِ ، وَمَعَهُ رَهْطٌ مِنْ أَهْلِ الشَّامِ فِيهِمْ حَبِيبُ بْنُ مَسْلَمَةَ الْفِهْرِيُّ ، إِذْ قَالَ عُثْمَانُ وَذُكِرَ لَهُ التَّمَتُّعُ بِالْعُمْرَةِ إِلَى الْحَجِّ : " إِنَّ أَتَمَّ لِلْحَجِّ وَالْعُمْرَةِ أَنْ لَا يَكُونَا فِي أَشْهُرِ الْحَجِّ ، فَلَوْ أَخَّرْتُمْ هَذِهِ الْعُمْرَةَ حَتَّى تَزُورُوا هَذَا الْبَيْتَ زَوْرَتَيْنِ كَانَ أَفْضَلَ ، فَإِنَّ اللَّهَ تَعَالَى قَدْ وَسَّعَ فِي الْخَيْرِ ، وَعَلِيُّ بْنُ أَبِي طَالِبٍ رَضِيَ اللَّهُ عَنْهُ فِي بَطْنِ الْوَادِي يَعْلِفُ بَعِيرًا لَهُ ، قَالَ : فَبَلَغَهُ الَّذِي قَالَ عُثْمَانُ ، فَأَقْبَلَ حَتَّى وَقَفَ عَلَى عُثْمَانَ رَضِيَ اللَّهُ عَنْهُ ، فَقَالَ : أَعَمَدْتَ إِلَى سُنَّةٍ سَنَّهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَرُخْصَةٍ رَخَّصَ اللَّهُ تَعَالَى بِهَا لِلْعِبَادِ فِي كِتَابِهِ ، تُضَيِّقُ عَلَيْهِمْ فِيهَا ، وَتَنْهَى عَنْهَا ، وَقَدْ كَانَتْ لِذِي الْحَاجَةِ وَلِنَائِي الدَّارِ ، ثُمَّ أَهَلَّ بِحَجَّةٍ وَعُمْرَةٍ مَعًا ، فَأَقْبَلَ عُثْمَانُ رَضِيَ اللَّهُ عَنْهُ عَلَى النَّاسِ ، فَقَالَ : وَهَلْ نَهَيْتُ عَنْهَا ؟ إِنِّي لَمْ أَنْهَ عَنْهَا ، إِنَّمَا كَانَ رَأْيًا أَشَرْتُ بِهِ ، فَمَنْ شَاءَ أَخَذَ بِهِ ، وَمَنْ شَاءَ تَرَكَهُ " .
Sayyiduna Abdullah bin Zubair (may Allah be pleased with him) says: By Allah! We were with Sayyiduna Uthman (may Allah be pleased with him) at the place of Juhfa when a delegation from the people of Syria came to him, among whom was Habib bin Maslamah Fahri. The mention of Hajj Tamattu' was brought up before Sayyiduna Uthman (may Allah be pleased with him), so he said: The completion of Hajj and Umrah is that both should not be combined in the months of Hajj. If you delay your Umrah and visit the House of Allah twice, then this is more virtuous, because Allah Almighty has placed ease and spaciousness in good deeds. At that time, Sayyiduna Ali (may Allah be pleased with him) was in the valley feeding his camel. When he learned of what Sayyiduna Uthman (may Allah be pleased with him) had said, he came to him and said: Will you prevent people from a Sunnah of the Prophet (peace and blessings of Allah be upon him) and from the concession which Allah has given His servants in the Qur'an, and thereby put them in hardship? Whereas for the needy person and for the one whose house is far, this ruling, i.e., Hajj Tamattu', still remains. After saying this, Sayyiduna Ali (may Allah be pleased with him) entered into the state of Ihram for both Hajj and Umrah (so that the permissibility of this would become clear to the people). Upon this, Sayyiduna Uthman (may Allah be pleased with him) came before the people and asked them: Have I prohibited Hajj Tamattu'? I have not prohibited it; it was merely an opinion which I suggested. Whoever wishes may accept it, and whoever wishes may leave it.
