Hadith 7026

(حديث مرفوع) حَدَّثَنَا يَعْقُوبُ ، حَدَّثَنَا أَبِي ، عَنِ ابْنِ إِسْحَاقَ ، قَالَ : ذَكَرَ عَمْرُو بْنُ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ ، قَالَ : " قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي عَقْلِ الْجَنِينِ إِذَا كَانَ فِي بَطْنِ أُمِّهِ ، بِغُرَّةٍ عَبْدٍ أَوْ أَمَةٍ ، فَقَضَى بِذَلِكَ فِي امْرَأَةِ حَمَلِ بْنِ مَالِكِ بْنِ النَّابِغَةِ الْهُذَلِيِّ " .
It is narrated from Sayyiduna Ibn Amr, may Allah be pleased with him, that regarding the compensation (diyah) for a fetus, that is, a child in the mother's womb (if someone kills it), the Prophet Muhammad, peace and blessings be upon him, decreed one "ghurra," that is, a male or female slave. This decision was made by the Prophet, peace and blessings be upon him, concerning the wife of Sayyiduna Haml bin Malik bin Nabigha Hudhali, may Allah be pleased with him.
