Hadith 6119

(حديث مرفوع) حَدَّثَنَا مُحَمَّدُ بْنُ عُبَيْدٍ ، حَدَّثَنَا عَبْدُ الْمَلِكِ يَعْنِي ابْنَ أَبِي سُلَيْمَانَ ، عَنْ أَنَسِ بْنِ سِيرِينَ ، عَنْ ابْنِ عُمَرَ ، قَالَ : سَأَلْتُهُ عَنِ امْرَأَتِهِ الَّتِي طَلَّقَ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : طَلَّقْتُهَا وَهِيَ حَائِضٌ ، فَذَكَرْتُ ذَلِكَ لِعُمَرَ ، فَذَكَرَهُ عُمَرُ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مُرْهُ فَلْيُرَاجِعْهَا ، إِذَا طَهُرَتْ طَلَّقَهَا فِي طُهْرِهَا لِلسُّنَّةِ " ، قَالَ : فَفَعَلْتُ , قَالَ أَنَسٌ : فَسَأَلْتُهُ , هَلْ اعْتَدَدْتَ بِالَّتِي طَلَّقْتَهَا وَهِيَ حَائِضٌ ؟ قَالَ : وَمَا لِي لَا أَعْتَدُّ بِهَا ، إِنْ كُنْتُ عَجَزْتُ وَاسْتَحْمَقْتُ ! ! .
Anas bin Sirin says that once I requested Sayyiduna Ibn Umar (may Allah be pleased with them both) to narrate the incident of divorcing his wife. He said: I divorced my wife while she was in her "periods." Sayyiduna Umar Farooq (may Allah be pleased with him) mentioned this to the Prophet (peace and blessings be upon him), so he said: Tell him to take his wife back, and when she becomes "pure," then in those days of purity he may divorce her. I asked: Did you count the divorce that was given during her "periods"? He said: Why would I not count it? If I had not done so, people would have considered me foolish.
