Hadith 6078

(حديث مرفوع) حَدَّثَنَا يُونُسُ ، حَدَّثَنَا حَمَّادٌ يَعْنِي ابْنَ زَيْدٍ ، حَدَّثَنَا أَيُّوبُ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ , أَنَّ عُمَرَ بْنَ الْخَطَّابِ أَصَابَ أَرْضًا مِنْ يَهُودِ بَنِي حَارِثَةَ ، يُقَالُ لَهَا : ثَمْغٌ ، فَقَالَ : يَا رَسُولَ اللَّهِ ، إِنِّي أَصَبْتُ مَالًا نَفِيسًا أُرِيدُ أَنْ أَتَصَدَّقَ بِهِ ، قَالَ : " فَجَعَلَهَا صَدَقَةً ، لَا تُبَاعُ ، وَلَا تُوهَبُ ، وَلَا تُورَثُ ، يَلِيهَا ذَوُو الرَّأْيِ مِنْ آلِ عُمَرَ ، فَمَا عَفَا مِنْ ثَمَرَتِهَا جُعِلَ فِي سَبِيلِ اللَّهِ تَعَالَى ، وَابْنِ السَّبِيلِ ، وَفِي الرِّقَابِ ، وَالْفُقَرَاءِ ، وَلِذِي الْقُرْبَى ، وَالضَّعِيفِ ، وَلَيْسَ عَلَى مَنْ وَلِيَهَا جُنَاحٌ أَنْ يَأْكُلَ بِالْمَعْرُوفِ ، أَوْ يُؤْكِلَ ، صَدِيقًا غَيْرَ مُتَمَوِّلٍ مِنْهُ مَالًا " ، قَالَ حَمَّادٌ : فَزَعَمَ عَمْرُو بْنُ دِينَارٍ , أَنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ كَانَ يُهْدِي إِلَى عَبْدِ اللَّهِ بْنِ صَفْوَانَ مِنْهُ ، قَالَ : فَتَصَدَّقَتْ حَفْصَةُ بِأَرْضٍ لَهَا عَلَى ذَلِكَ ، وَتَصَدَّقَ ابْنُ عُمَرَ بِأَرْضٍ لَهُ عَلَى ذَلِكَ ، وَوَلِيَتْهَا حَفْصَةُ .
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that Sayyiduna Umar Farooq (may Allah be pleased with him) received a piece of land from the Jews of Banu Haritha in Khaybar as his share, which was called Thamgh. He presented himself before the Prophet (peace and blessings of Allah be upon him) and said, "O Messenger of Allah! A piece of land from Khaybar has come to me as my share, and I have never received any wealth better than this. I wish to give it in charity." So Sayyiduna Umar Farooq (may Allah be pleased with him) dedicated it as a waqf for the poor, close relatives, slaves, warriors, travelers, and guests, such that it could neither be sold, nor gifted, nor inherited. However, the people of opinion from the family of Imran would be its administrators. And he said: There is no harm for the administrator of this land to eat from it in a good manner, or to feed a friend "who does not intend to enrich himself from it." Amr bin Dinar says that Sayyiduna Ibn Umar (may Allah be pleased with them both) used to send a gift from it to Abdullah bin Safwan. Sayyidah Hafsa (may Allah be pleased with her) also gave her land in charity. Sayyiduna Ibn Umar (may Allah be pleased with them both) also gave his land in charity on the same conditions, and Sayyidah Hafsa (may Allah be pleased with her) was its supervisor.
