Hadith 6038

(حديث مرفوع) حَدَّثَنَا هَاشِمٌ ، حَدَّثَنَا لَيْثٌ ، عَنْ نَافِعٍ ، عَنْ عَبْدِ اللَّهِ ، قَالَ : سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ , يَقُولُ : " أَيُّمَا مَمْلُوكٍ كَانَ بَيْنَ شَرِيكَيْنِ فَأَعْتَقَ أَحَدُهُمَا نَصِيبَهُ ، فَإِنَّهُ يُقَامُ فِي مَالِ الَّذِي أَعْتَقَ قِيمَةَ عَدْلٍ ، فَيُعْتِقُ إِنْ بَلَغَ ذَلِكَ مَالَهُ " .
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: If a slave is jointly owned by two people, and one of them frees his share of the slave, then the value of the slave will be assessed, and if the one who freed his share has enough wealth to cover the full value, the slave will be set free.
