Hadith 6006

(حديث مرفوع) حَدَّثَنَا هَاشِمٌ ، حَدَّثَنَا لَيْثٌ ، حَدَّثَنِي نَافِعٌ ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ ، عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، أَنَّهُ قَالَ : " إِذَا تَبَايَعَ الرَّجُلَانِ ، فَكُلُّ وَاحِدٍ مِنْهُمَا بِالْخِيَارِ ، مَا لَمْ يَتَفَرَّقَا ، فَكَانَا جَمِيعًا ، وَيُخَيِّرُ أَحَدُهُمَا الْآخَرَ ، فَإِنْ خَيَّرَ أَحَدُهُمَا الْآخَرَ ، فَتَبَايَعَا عَلَى ذَلِكَ ، فَقَدْ وَجَبَ الْبَيْعُ ، وَإِنْ تَفَرَّقَا بَعْدَ أَنْ تَبَايَعَا ، وَلَمْ يَتْرُكْ وَاحِدٌ مِنْهُمَا الْبَيْعَ ، فَقَدْ وَجَبَ الْبَيْعُ " .
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: When two men engage in a transaction, each of them has the right of option as long as they do not separate. And if one of them gives the option to the other and both agree upon the sale on that basis, then the sale becomes binding. And if, after the sale, both separate from each other and neither of them has abandoned the sale, then the sale also becomes binding.
