Hadith 595

(حديث مرفوع) حَدَّثَنَا سُفْيَانُ ، عَنْ أَبِي إِسْحَاقَ ، عَنِ الْحَارِثِ ، عَنْ عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ ، قَضَى مُحَمَّدٌ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَنَّ الدَّيْنَ قَبْلَ الْوَصِيَّةِ ، وَأَنْتُمْ تَقْرَءُونَ الْوَصِيَّةَ قَبْلَ الدَّيْنِ ، وَأَنَّ أَعْيَانَ بَنِي الْأُمِّ يَتَوَارَثُونَ دُونَ بَنِي الْعَلَّاتِ " .
It is narrated from Sayyiduna Ali (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) decreed that the payment of the deceased's debt will be carried out before the execution of the will, even though in the Qur'an the mention of the will comes before the debt. And that uterine brothers will be heirs, but consanguine brothers will not be heirs. (Note: Brothers sharing the same mother are called uterine, and brothers sharing the same father are called consanguine.)
