Hadith 5788

(حديث مرفوع) حَدَّثَنَا مُحَمَّدُ بْنُ عُبَيْدٍ ، حَدَّثَنَا عُبَيْدُ اللَّهِ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " مَنْ اشْتَرَى نَخْلًا قَدْ أُبِّرَتْ ، فَثَمَرَتُهَا لِلَّذِي أَبَّرَهَا ، إِلَّا أَنْ يَشْرِطَ الَّذِي اشْتَرَاهَا " .
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever sells a tree in which date palms have been pollinated, its fruit will belong to the seller, unless the buyer stipulates at the time of purchase (that he is buying the tree along with its fruit)."
