(حديث مرفوع) حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ ، حَدَّثَنَا شُعْبَةُ ، سَمِعْتُ عَبْدَ رَبِّهِ بْنَ سَعِيدٍ يُحَدِّثُ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : " أَيُّمَا رَجُلٍ بَاعَ نَخْلًا قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِلْأَوَّلِ ، وَأَيُّمَا رَجُلٍ بَاعَ مَمْلُوكًا وَلَهُ مَالٌ ، فَمَالُهُ لِرَبِّهِ الْأَوَّلِ ، إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ " ، قَالَ شُعْبَةُ : فَحَدَّثْتُهُ بِحَدِيثِ أَيُّوبَ ، عَنْ نَافِعٍ ، أَنَّهُ حَدَّثَ بِالنَّخْلِ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَالْمَمْلُوكِ عَنْ عُمَرَ ، قَالَ عَبْدُ رَبِّهِ : لَا أَعْلَمُهُمَا جَمِيعًا إِلَّا عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، ثُمَّ قَالَ مَرَّةً أُخْرَى : فَحَدَّثَ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَلَمْ يَشُكَّ .
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever sells a tree in which dates have been pollinated, its fruit will belong to the seller, unless the buyer stipulates at the time of purchase (that he is buying the tree along with its fruit). And whoever sells a wealthy slave, his property will belong to his former master, unless the buyer stipulates otherwise."
