Hadith 5398

(حديث مرفوع) حَدَّثَنَا حَسَنٌ ، حَدَّثَنَا ابْنُ لَهِيعَةَ ، حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ أَبِي جَعْفَرٍ ، عَنْ زَيْدِ بْنِ أَسْلَمَ ، قَالَ : سَمِعْتُ رَجُلًا سَأَلَ عَبْدَ اللَّهِ بْنَ عُمَرَ عَنْ بَيْعِ الْمُزَايَدَةِ ، فَقَالَ ابْنُ عُمَرَ : " نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يَبِيعَ أَحَدُكُمْ عَلَى بَيْعِ أَخِيهِ ، إِلَّا الْغَنَائِمَ وَالْمَوَارِيثَ " .
Zaid bin Aslam (may Allah have mercy on him) says that a man asked Sayyiduna Ibn Umar (may Allah be pleased with them both) about the sale in auction. He replied that the Messenger of Allah (peace and blessings be upon him) forbade that a person should sell over his brother’s sale, except in the case of spoils of war or inherited property.
