Hadith 5270

(حديث مرفوع) حَدَّثَنَا رَوْحٌ ، حَدَّثَنَا مُحَمَّدُ بْنُ أَبِي حَفْصَةَ ، حَدَّثَنَا ابْنُ شِهَابٍ ، عَنْ سَالِمٍ ، عَنْ أَبِيهِ ، أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ ، فَذَكَرَ ذَلِكَ إِلَى عُمَرَ ، فَانْطَلَقَ عُمَرُ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَخْبَرَهُ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لِيُمْسِكْهَا حَتَّى تَحِيضَ غَيْرَ هَذِهِ الْحَيْضَةِ ، ثُمَّ تَطْهُرَ ، فَإِنْ بَدَا لَهُ أَنْ يُطَلِّقَهَا ، فَلْيُطَلِّقْهَا كَمَا أَمَرَهُ اللَّهُ عَزَّ وَجَلَّ ، وَإِنْ بَدَا لَهُ أَنْ يُمْسِكَهَا ، فَلْيُمْسِكْهَا " .
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that he divorced his wife while she was in her "period of menstruation," and he also informed Sayyiduna Umar (may Allah be pleased with him) about this matter. Sayyiduna Umar (may Allah be pleased with him) presented himself in the court of the Messenger of Allah (peace and blessings be upon him) and informed the Prophet (peace and blessings be upon him) about it. The Prophet (peace and blessings be upon him) said: "He should keep her with him until she becomes pure from that period, then another period comes and she becomes pure from that as well. Then, if he decides to divorce her, he may divorce her according to the command of Allah, and if he decides to keep her, he may keep her."
