Hadith 5009

(حديث مرفوع) حَدَّثَنَا يَزِيدُ ، أَخْبَرَنَا عَبْدُ الْمَلِكِ ، سَمِعْتُ سَعِيدَ بْنَ جُبَيْرٍ ، قَالَ : سَأَلْتُ ابْنَ عُمَرَ ، فَقُلْتُ : يَا أَبَا عَبْدِ الرَّحْمَنِ ، الْمُتَلَاعِنَيْنِ يُفَرَّقُ بَيْنَهُمَا ؟ قَال : سُبْحَانَ اللَّهِ ! نَعَمْ ، إِنَّ أَوَّلَ مَنْ سَأَلَ عَنْ ذَلِكَ فُلَانٌ ، قَالَ : يَا رَسُولَ اللَّهِ ، " أَرَأَيْتَ لَوْ أَنَّ أَحَدَنَا رَأَى امْرَأَتَهُ عَلَى فَاحِشَةٍ ، كَيْفَ يَصْنَعُ ؟ إِنْ سَكَتَ ، سَكَتَ عَلَى أَمْرٍ عَظِيمٍ ، وَإِنْ تَكَلَّمَ فَمِثْلُ ذَلِكَ ؟ فَسَكَتَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَلَمْ يُجِبْهُ ، فَقَامَ لِحَاجَتِهِ ، فَلَمَّا كَانَ بَعْدَ ذَلِكَ ، أَتَى رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : إِنَّ الَّذِي سَأَلْتُكَ عَنْهُ قَدْ ابْتُلِيتُ بِهِ ، قَالَ : فَأَنْزَلَ اللَّهُ تَعَالَى هَذِهِ الْآيَاتِ فِي سُورَةِ النُّورِ : وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ سورة النور آية 6 حَتَّى خَتَمَ الْآيَاتِ ، فَدَعَا الرَّجُلَ ، فَتَلَاهُنَّ عَلَيْهِ ، وَذَكَّرَهُ بِاللَّهِ تَعَالَى ، وَأَخْبَرَهُ أَنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الْآخِرَةِ ، فَقَالَ : وَالَّذِي بَعَثَكَ بِالْحَقِّ ، مَا كَذَبْتُ عَلَيْهَا ، ثُمَّ دَعَا الْمَرْأَةَ ، فَوَعَظَهَا وَذَكَّرَهَا ، وَأَخْبَرَهَا بِأَنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الْآخِرَةِ ، فَقَالَتْ : وَالَّذِي بَعَثَكَ بِالْحَقِّ ، إِنَّهُ لَكَاذِبٌ ، فَدَعَا الرَّجُلَ ، فَشَهِدَ أَرْبَعَ شَهَادَاتٍ بِاللَّهِ إِنَّهُ لَمِنْ الصَّادِقِينَ ، وَالْخَامِسَةَ أَنَّ لَعْنَةَ اللَّهِ عَلَيْهِ إِنْ كَانَ مِنَ الْكَاذِبِينَ ، ثُمَّ دَعَا بِالْمَرْأَةِ ، فَشَهِدَتْ أَرْبَعَ شَهَادَاتٍ بِاللَّهِ إِنَّهُ لَمِنْ الْكَاذِبِينَ ، وَالْخَامِسَةَ أَنَّ غَضَبَ اللَّهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ ، ثُمَّ فَرَّقَ بَيْنَهُمَا " .
Saeed bin Jubair (may Allah have mercy on him) says that I asked Sayyiduna Ibn Umar (may Allah be pleased with them both): O Abu Abdur Rahman! Should separation be made between those who perform li'an (mutual cursing)? Upon hearing my question, he said, "Subhan Allah," and said: The first person to ask about li'an was so-and-so, he said, "O Messenger of Allah! Tell me, if a man sees his wife committing adultery, if he speaks, he says a very grave thing, and if he remains silent, he remains silent over such a great matter?" The Prophet (peace and blessings of Allah be upon him) remained silent instead of answering his question. After a short while, that person again came to the Prophet (peace and blessings of Allah be upon him) and said, "I have been afflicted with the matter I asked you about." Upon this, Allah revealed these verses of Surah An-Nur «والذين يرمون ازواجهم ...... ان كان من الصدقين». The Prophet (peace and blessings of Allah be upon him) called that man and recited these verses before him. Then, in accordance with these verses, he began the li'an with the man, admonished and advised him, and said, "The punishment of this world is lighter than the punishment of the Hereafter." He said, "By Him Who sent you with the truth, I am not lying to you." Secondly, the Prophet (peace and blessings of Allah be upon him) called the woman, admonished and advised her, and said, "The punishment of this world is lighter than the punishment of the Hereafter." She said, "By Him Who sent you with the truth, he is lying." Then the Prophet (peace and blessings of Allah be upon him) began with the man, and he swore by Allah four times, testifying that he was truthful, and the fifth time he said, "If I am lying, then may the curse of Allah be upon me." Then he turned to the woman, and she also swore by Allah four times, testifying that he was lying, and the fifth time she said, "If he is truthful, then may the wrath of Allah be upon me." Then the Prophet (peace and blessings of Allah be upon him) separated the two of them.
