Hadith 4852

(حديث مرفوع) حَدَّثَنَا يَزِيدُ ، أَخْبَرَنَا حَمَّادُ بْنُ سَلَمَةَ ، عَنْ عِكْرِمَةَ بْنِ خَالِدٍ الْمَخْزُومِيِّ ، عَنِ ابْنِ عُمَرَ أَنَّ رَجُلًا اشْتَرَى نَخْلًا قَدْ أَبَّرَهَا صَاحِبُهَا ، فَخَاصَمَهُ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، " فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ الثَّمَرَةَ لِصَاحِبِهَا الَّذِي أَبَّرَهَا ، إِلَّا أَنْ يَشْتَرِطَ الْمُشْتَرِي " .
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that a man bought a grafted date-palm tree. The two had a dispute. This dispute was presented before the Noble Prophet (peace and blessings be upon him), so the Noble Prophet (peace and blessings be upon him) decided that the fruit belongs to the owner of the tree who grafted it, except if the buyer had stipulated the condition of buying the tree along with its fruit.
