Hadith 4635

(حديث مرفوع) حَدَّثَنَا إِسْمَاعِيلُ ، حَدَّثَنَا أَيُّوبُ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَال : " مَنْ أَعْتَقَ نَصِيبًا أَوْ قَالَ : شَقِيصًا لَهُ ، أَوْ قَالَ : شِرْكًا لَهُ فِي عَبْدٍ ، فَكَانَ لَهُ مِنَ الْمَالِ مَا بَلَغَ ثَمَنَهُ بِقِيمَةِ الْعَدْلِ ، فَهُوَ عَتِيقٌ ، وَإِلَّا فَقَدْ عَتَقَ مِنْهُ " قَالَ أَيُّوبُ : كَانَ نَافِعٌ رُبَّمَا قَالَ فِي هَذَا الْحَدِيثِ وَرُبَّمَا لَمْ يَقُلْهُ ، فَلَا أَدْرِي أَهُوَ فِي الْحَدِيثِ ، أَوْ قَالَهُ نَافِعٌ مِنْ قِبَلِهِ ؟ يَعْنِي قَوْلَهُ : " فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ " .
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever frees a slave according to his share, then it will be according to the value of that slave. Thus, the value of the slave will be assessed, the remaining partners will be given the price of their shares, and the slave will be freed. Otherwise, only the portion that he has freed will remain freed."
