Hadith 4590

(حديث مرفوع) حَدَّثَنَا سُفْيَانُ ، عَنْ عَمْرٍو ، عَنْ إِسْمَاعِيلَ الشَّيْبَانِيِّ : بِعْتُ مَا فِي رُؤُوسِ نَخْلِي بِمِئَةِ وَسْقٍ ، إِنْ زَاد فَلَهُمْ ، وَإِنْ نَقَصَ فَلَهُمْ ، فَسَأَلْتُ ابْنَ عُمَرَ ، فَقَالَ : " نَهَى عَنْهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَرَخَّصَ فِي الْعَرَايَا " .
Ismail Shaybani (may Allah have mercy on him) says that once I sold the dates of my orchard for one hundred wasqs, whether they turned out to be more or less, they would belong to the buyer. Then I asked Sayyiduna Ibn Umar (may Allah be pleased with them both) about this, and he said that the Noble Prophet (peace and blessings be upon him) forbade this, but permitted the sale of ‘ariyah with estimation.
