Hadith 4510

(حديث مرفوع) حَدَّثَنَا إِسْمَاعِيلُ ، حَدَّثَنَا أَيُّوبُ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، قَالَ أَيُّوبُ : لَا أَعْلَمُهُ إِلَّا عَن لنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " مَنْ حَلَفَ ، فَاسْتَثْنَى ، فَهُوَ بِالْخِيَارِ ، إِنْ شَاءَ أَنْ يَمْضِيَ عَلَى يَمِينِهِ مَضَى ، وَإِنْ شَاءَ أَنْ يَرْجِعَ غَيْرَ حِنْثٍ " ، أَوْ قَالَ : " غَيْرَ حَرِجٍ " .
It is narrated, most likely as a marfu’ hadith, from Sayyiduna Ibn Umar (may Allah be pleased with them both) that whoever says "In sha Allah" while taking an oath, has the choice: if he wishes to fulfill his oath, he may do so, and if he wishes to retract from it, he may do so without becoming a perjurer.
