(حديث مرفوع) حَدَّثَنَا
إِسْمَاعِيلُ ، أَخْبَرَنَا
أَيُّوبُ ، عَنْ
نَافِعٍ ، عَنِ
ابْنِ عُمَرَ ، قَالَ : قَدْ عَلِمْتُ أَنَّ الْأَرْضَ كَانَتْ تُكْرَى عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهِ عَلَيْهِ وَسَلَّمَ بِمَا عَلَى الْأَرْبِعَاءِ وَشَيْءٍ مِنَ التِّبْنِ ، لَا أَدْرِي كَمْ هُوَ ، وَإِنَّ ابْنَ عُمَرَ ، كَانَ يُكْرِي أَرْضَهُ فِي عَهْدِ أَبِي بَكْرٍ ، وَعَهْدِ عُمَرَ وَعَهْدِ عُثْمَانَ ، وَصَدْرِ إِمَارَةِ مُعَاوِيَةَ ، حَتَّى إِذَا كَانَ فِي آخِرِهَا بَلَغَهُ أَنَّ رَافِعًا يُحَدِّثُ فِي ذَلِكَ بِنَهْيِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَأَتَاهُ وَأَنَا مَعَهُ ، فَسَأَلَهُ ، فَقَالَ : نَعَمْ ، " نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ كِرَاءِ الْمَزَارِعِ ، فَتَرَكَهَا ابْنُ عُمَر ، فَكَانَ لَا يُكْرِيهَا ، فَكَانَ إِذَا سُئِلَ يَقُول : زَعَمَ ابْنُ خَدِيجٍ ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " نَهَى عَنْ كِرَاءِ الْمَزَارِعِ " .
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that I know that in the blessed era of the Noble Prophet (peace and blessings be upon him), land used to be given on rent in exchange for grass and a small amount of straw, the exact amount of which I do not remember. Sayyiduna Ibn Umar (may Allah be pleased with them both) himself used to give land on rent during the eras of Abu Bakr, Umar, Uthman, and in the early period of the rule of Sayyiduna Amir Muawiyah (may Allah be pleased with him). However, in the later period of Sayyiduna Muawiyah (may Allah be pleased with him), he came to know that Sayyiduna Rafi’ bin Khadij (may Allah be pleased with him) narrates the prohibition of the Noble Prophet (peace and blessings be upon him) regarding giving land on rent. So he went to him, and I was with him. He asked Sayyiduna Rafi’ (may Allah be pleased with him) about this matter, and he replied: Yes! The Noble Prophet (peace and blessings be upon him) forbade giving land on rent. Upon hearing this, Sayyiduna Ibn Umar (may Allah be pleased with them both) abandoned this practice and thereafter never gave land on rent to anyone. And when someone would ask him, he would say that Sayyiduna Rafi’ bin Khadij (may Allah be pleased with him) holds the opinion that the Noble Prophet (peace and blessings be upon him) forbade giving land on rent.
