(حديث مرفوع) حَدَّثَنَا عَبْد اللَّهِ ، قَالَ : قَرَأْتُ عَلَى أَبِي مِنْ هَاهُنَا ، فَأَقَرَّ بِهِ ، وَقَالَ : حَدَّثَنِي مُحَمَّدُ بْنُ إِدْرِيسَ الشَّافِعِيُّ ، أَخْبَرَنَا سَعِيدُ بْنُ سَالِمٍ يَعْنِي الْقَدَّاحَ ، أَخْبَرَنَا ابْنُ جُرَيْجٍ ، أَنَّ إِسْمَاعِيلَ بْنَ أُمَيَّةَ أَخْبَرَهُ ، عَنْ عَبْدِ الْمَلِكِ بْنِ عُمَيْرٍ ، أَنَّهُ قَالَ : حَضَرْتُ أَبَا عُبَيْدَةَ بْنَ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ ، وَأَتَاهُ رَجُلَانِ يَتَبَايَعَانِ سِلْعَةً ، فَقَالَ هَذَا : أَخَذْتُ بِكَذَا وَكَذَا ، وَقَالَ هَذَا : بِعْتُ بِكَذَا وَكَذَا ، فَقَالَ أَبُو عُبَيْدَةَ : أُتِيَ عَبْدُ اللَّهِ بْنُ مَسْعُودٍ فِي مِثْلِ هَذَا ، فَقَالَ : حَضَرْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أُتِيَ فِي مِثْلِ هَذَا ، " فَأَمَرَ بِالْبَائِعِ أَنْ يُسْتَحْلَفَ ، ثُمَّ يُخَيَّرَ الْمُبْتَاعُ ، إِنْ شَاءَ أَخَذَ ، وَإِنْ شَاءَ تَرَكَ " . حَدَّثَنَا عَبْد اللَّهِ ، قَالَ : قَرَأْتُ عَلَى أَبِي ، قَالَ : أُخْبِرْتُ ، عَنْ هِشَامِ بْنِ يُوسُفَ ، فِي الْبَيِّعَيْنِ فِي حَدِيثِ ابْنِ جُرَيْجٍ ، عَنْ إِسْمَاعِيلَ بْنِ أُمَيَّةَ ، عَنْ عَبْدِ الْمَلِكِ بْنِ عُبَيْدٍ . وقَالَ أَبِي : قَالَ حَجَّاجٌ الْأَعْوَرُ : عَبْدُ الْمَلِكِ بْنُ عُبَيْدَةَ .
Abdul Malik bin Umair says that once I was present in the company of Abu Ubaidah bin Abdullah bin Mas’ud (may Allah be pleased with him), when two men came to him who had bought and sold something. The buyer said, “I bought this item for such and such amount,” and the seller said, “I sold this item for such and such amount.” Abu Ubaidah said that a similar case had come before Sayyiduna Ibn Mas’ud (may Allah be pleased with him), and he had said that such an incident had also occurred in the presence of the Prophet (peace and blessings be upon him), and I was present there at that time. The Prophet (peace and blessings be upon him) ordered the seller to take an oath, then gave the buyer the choice: “If he wishes, he may take it, and if he wishes, he may leave it.” The previous hadith is also narrated through this second chain.
