(حديث مرفوع) حَدَّثَنَا

شُعْبَةُ ، عَنْ
أَبِي قَيْسٍ ، عَنْ
هُزَيْلِ بْنِ شُرَحْبِيلَ ، قَالَ : سَأَلَ رَجُلٌ أَبَا مُوسَى الْأَشْعَرِيَّ ، عَنِ امْرَأَةٍ تَرَكَتْ ابْنَتَهَا ، وَابْنَةَ ابْنِهَا ، وَأُخْتَهَا ؟ فَقَالَ : النِّصْفُ لِلِابْنَةِ ، وَلِلْأُخْتِ النِّصْفُ ، وَقَالَ : ائْتِ ابْنَ مَسْعُودٍ ، فَإِنَّهُ سَيُتَابِعُنِي ، قَالَ : فَأَتَوْا
ابْنَ مَسْعُودٍ ، فَأَخْبَرُوهُ بِقَوْلِ أَبِي مُوسَى ، فَقَالَ : لَقَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ ، لَأَقْضِيَنَّ فِيهَا بِقَضَاءِ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ شُعْبَةُ : وَجَدْتُ هَذَا الْحَرْفَ مَكْتُوبًا لَأَقْضِيَنَّ فِيهَا بِقَضَاءِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لِلِابْنَةِ النِّصْفُ ، وَلِابْنَةِ الِابْنِ السُّدُسُ تَكْمِلَةَ الثُّلُثَيْنِ ، وَمَا بَقِيَ فَلِلْأُخْتِ " . فَأَتَوْا أَبَا مُوسَى ، فَأَخْبَرُوهُ بِقَوْلِ ابْنِ مَسْعُودٍ ، فَقَالَ أَبُو مُوسَى : لَا تَسْأَلُونِي عَنْ شَيْءٍ مَا دَامَ هَذَا الْحَبْرُ بَيْنَ أَظْهُرِكُمْ .
Huzail bin Shurahbil says that once a man came to Sayyiduna Abu Musa (may Allah be pleased with him) and asked him this issue: If a person’s heirs include a daughter, a granddaughter, and a real sister, how will the inheritance be distributed? He replied: Half of the total wealth will go to the daughter and the other half to the sister, and you should go to Sayyiduna Ibn Mas’ud (may Allah be pleased with him) and ask him this issue as well; he will agree with and support us. So that man went to Sayyiduna Ibn Mas’ud (may Allah be pleased with him) and asked him the issue, also mentioning the answer of Sayyiduna Abu Musa (may Allah be pleased with him). Sayyiduna Ibn Mas’ud (may Allah be pleased with him) said: If I also give this same verdict, then I will go astray and will not remain among the rightly guided. I will give the same decision that the Prophet (peace and blessings be upon him) gave: “The daughter will get half of the total wealth, the granddaughter will get one-sixth so that two-thirds are completed, and whatever remains will go to the sister.” People went to Sayyiduna Abu Musa (may Allah be pleased with him) and informed him of Sayyiduna Ibn Mas’ud’s (may Allah be pleased with him) opinion, so he said: As long as such a great scholar is present among you, do not ask me questions.
