Hadith 2963

(حديث مرفوع) حَدَّثَنَا رَوْحٌ ، حَدَّثَنَا ابنُ جُرَيْجٍ ، قَالَ : حَدَّثَنِي مُحَمَّدُ بْنُ عَلِيِّ بْنِ رُكَانَةَ ، عَنْ عِكْرِمَةَ مَوْلَى ابْنِ عَبَّاسٍ ، عَنْ ابْنِ عَبَّاسٍ : أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَمْ يَقِتْ فِي الْخَمْرِ حَدًّا ، قَالَ ابْنُ عَبَّاسٍ : شَرِبَ رَجُلٌ ، فَسَكِرَ ، فَلُقِيَ يَمِيلُ فِي فَجٍّ ، فَانْطُلِقَ بِهِ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : فَلَمَّا حَاذَى بِدَارِ عَبَّاسٍ نْفَلَتَ فَدَخَلَ عَلَى عَبَّاسٍ ، فَالْتَزَمَهُ مِنْ وَرَائِهِ ، فَذَكَرُوا ذَلِكَ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَضَحِكَ ، وَقَالَ : " قَدْ فَعَلَهَا ؟ ! " ثُمَّ لَمْ يَأْمُرْهُمْ فِيهِ بِشَيْءٍ .
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that there was an occasion when the Prophet (peace and blessings be upon him) did not enforce the punishment for drinking alcohol. It happened in such a way that a man became intoxicated after drinking alcohol and was staggering here and there on the road. A person met him and caught him, intending to take him to the Prophet (peace and blessings be upon him). When they reached near the house of Sayyiduna Abbas (may Allah be pleased with him), the man freed his hand and ran away, entering the house of Sayyiduna Abbas (may Allah be pleased with him) and clinging to him from behind. People mentioned this incident to the Prophet (peace and blessings be upon him), so the Prophet (peace and blessings be upon him) laughed and said, "Did he do that?" Then the Prophet (peace and blessings be upon him) did not issue any command regarding him.
