مُحَمَّدُ بْنُ جَعْفَرٍ , قَالَ : حَدَّثَنَا
شُعْبَةُ , عَنْ
أَبِي بَكْرِ بْنِ أَبِي الْجَهْمِ , قَالَ : دَخَلْتُ أَنَا وَأَبُو سَلَمَةَ عَلَى
فَاطِمَةَ بِنْتِ قَيْسٍ , قَالَ : فَقَالَتْ : طَلَّقَنِي زَوْجِي فَلَمْ يَجْعَلْ لِي سُكْنَى وَلَا نَفَقَةً , قَالَتْ : وَوَضَعَ لِي عَشْرَةَ أَقْفِزَةٍ عِنْدَ ابْنِ عَمٍّ لَهُ : خَمْسَةً شَعِيرٍ , وَخَمْسَةً تَمْرٍ , قَالَتْ : فَأَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ , فَقُلْتُ ذَاكَ لَهُ ، قَالَ : فَقَالَ :
" صَدَقَ " , فَأَمَرَنِي أَنْ أَعْتَدَّ فِي بَيْتِ فُلَانٍ , قَالَ : وَكَانَ طَلَّقَهَا طَلَاقًا بَائِنً .
It is narrated from Hazrat Fatimah bint Qais (may Allah be pleased with her) that my husband Abu Amr bin Hafs bin Mughirah sent me a message of divorce one day, and along with it, he sent five qafiz of barley and five qafiz of dates. Other than this, he did not provide any residence or maintenance. I presented myself before the Prophet (peace and blessings be upon him) and mentioned the whole incident. The Prophet (peace and blessings be upon him) said: "He has spoken the truth; you will not receive any maintenance, and you should spend your waiting period (‘iddah) in the house of your paternal cousin Ibn Umm Maktum." It should be noted that her husband had given her an irrevocable divorce (talaq bain).
