حَدَّثَنَا
وَكِيعٌ ، قَالَ : حَدَّثَنَا
أُسَامَةُ بْنُ زَيْدٍ ، عَنْ
عَبْدِ اللَّهِ بْنِ رَافِعٍ ، عَنْ
أُمِّ سَلَمَةَ ، قَالَتْ : جَاءَ رَجُلَانِ مِنَ الْأَنْصَارِ يَخْتَصِمَانِ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي مَوَارِيثَ بَيْنَهُمَا قَدْ دُرِسَتْ ، لَيْسَ بَيْنَهُمَا بَيِّنَةٌ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :
" إِنَّكُمْ تَخْتَصِمُونَ إِلَيَّ ، وَإِنَّمَا أَنَا بَشَرٌ ، وَلَعَلَّ بَعْضَكُمْ أَلْحَنُ بِحُجَّتِهِ أَوْ قَدْ قَالَ لِحُجَّتِهِ مِنْ بَعْضٍ , فَإِنِّي أَقْضِي بَيْنَكُمْ عَلَى نَحْوِ مَا أَسْمَعُ ، فَمَنْ قَضَيْتُ لَهُ مِنْ حَقِّ أَخِيهِ شَيْئًا ، فَلَا يَأْخُذْهُ ، فَإِنَّمَا أَقْطَعُ لَهُ قِطْعَةً مِنَ النَّارِ يَأْتِي بِهَا إِسْطَامًا فِي عُنُقِهِ يَوْمَ الْقِيَامَةِ " , فَبَكَى الرَّجُلَانِ ، وَقَالَ كُلُّ وَاحِدٍ مِنْهُمَا : حَقِّي لِأَخِي ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَمَا إِذْ قُلْتُمَا ، فَاذْهَبَا فَاقْتَسِمَا ، ثُمَّ تَوَخَّيَا الْحَقَّ ، ثُمَّ اسْتَهِمَا ، ثُمَّ لِيَحْلِلْ كُلُّ وَاحِدٍ مِنْكُمَا صَاحِبَهُ " .
It is narrated from Hazrat Umm Salamah (may Allah be pleased with her) that once two Ansaris brought their case regarding inheritance to the Prophet (peace and blessings be upon him), and they did not have any witnesses with them. The Prophet (peace and blessings be upon him) said: "You people bring your disputes to me. It is possible that one of you may present his argument with such eloquence and clarity compared to the other that I may decide in his favor based on his argument. (Therefore, remember) if I accept someone's statement and decide in his favor regarding his brother's right, then understand that I am cutting a piece of fire for him and giving it to him, which he will hang around his neck on the Day of Resurrection." Upon hearing this, both of them began to weep and each said, "This is my brother's right." The Prophet (peace and blessings be upon him) said: "If this is the case, then go and divide it, draw lots in the right way, and make each other lawful for it."
