شُعْبَةُ ، عَنِ
الْحَكَمِ ، عَنْ
إِبْرَاهِيمَ ، عَنِ
الْأَسْوَدِ ، عَنْ
عَائِشَةَ : أَنَّهَا أَرَادَتْ أَنْ تَشْتَرِيَ بَرِيرَةَ لِلْعِتْقِ فَأَرَادَ مَوَالِيهَا أَنْ يَشْتَرِطُوا وَلَاءَهَا ، فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ :
" اشْتَرِيهَا ، إِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ " . وَخَيَّرَهَا مِنْ زَوْجِهَا ، وَكَانَ زَوْجُهَا حُرًّا . وَأُتِيَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِلَحْمٍ ، فَقِيلَ : هَذَا مَا تُصُدِّقَ بِهِ عَلَى بَرِيرَةَ ، فَقَالَ : " هُوَ لَهَا صَدَقَةٌ وَلَنَا هَدِيَّةٌ " .
It is narrated from Hazrat Aisha (may Allah be pleased with her) that she wanted to buy Barirah in order to set her free, but her owners made her allegiance (wala’) a condition for themselves. I mentioned this to the Prophet (peace and blessings be upon him), so the Prophet (peace and blessings be upon him) said: “Buy her and set her free, for the inheritance of the slave belongs to the one who sets her free.” Also, people used to give her (Barirah) something as charity, and she would give us some of it as a gift. I mentioned this to the Prophet (peace and blessings be upon him), so the Prophet (peace and blessings be upon him) said: “It is charity for her, and for you it is a gift, so you may eat it.” The narrator says that her husband was a free man.
