Hadith 23879

حَدَّثَنَا يَعْقُوبُ ، حَدَّثَنِي أَبِي ، عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ ، حَدَّثَنِي مُحَمَّدُ بْنُ جَعْفَرِ بْنِ الزُّبَيْرِ ، قَالَ : سَمِعْتُ زِيَادَ بْنَ ضَمْرَةَ بْنِ سَعِيدٍ السُّلَمِيَّ ، يُحَدِّثُ عُرْوَةَ بْنَ الزُّبَيْرِ ، عَنْ أَبِيهِ ضَمْيرَةَ ، وَعَنْ جَدِّهِ وَكَانَا شَهِدَا حُنَيْنًا مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَا : صَلَّى بِنَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الظُّهْرَ ثُمَّ عَمَدَ إِلَى ظِلِّ شَجَرَةٍ فَجَلَسَ فِيهِ وَهُوَ بِحُنَيْنٍ ، فَقَامَ إِلَيْهِ الْأَقْرَعُ بْنُ حَابِسٍ ، وَعُيَيْنَةُ بْنُ حِصْنِ بْنِ حُذَيْفَةَ بْنِ بَدْرٍ يَخْتَصِمَانِ فِي عَامِرِ بْنِ الْأَضْبَطِ الْأَشْجَعِيِّ ، وَعُيَيْنَةُ يَطْلُبُ بِدَمِ عَامِرٍ ، وَهُوَ يَوْمَئِذٍ رَئِيسُ غَطَفَانَ ، وَالْأَقْرَعُ بْنُ حَابِسٍ يَدْفَعُ عَنْ مُحَلَّمِ بْنِ جَثَّامَةَ بِمَكَانِهِ مِنْ خِنْدِفٍ ، فَتَدَاوَلَا الْخُصُومَةَ عِنْدَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، وَنَحْنُ نَسْمَعُ ، فَسَمِعْنَا عُيَيْنَةَ وَهُوَ يَقُولُ : وَاللَّهِ يَا رَسُولَ اللَّهِ لَا أَدَعُهُ حَتَّى أُذِيقَ نِسَاءَهُ مِنَ الْحَرِّ مَا ذَاقَ نِسَائِي ، وَرَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ : " بَلْ تَأْخُذُونَ الدِّيَةَ خَمْسِينَ فِي سَفَرِنَا هَذَا ، وَخَمْسِينَ إِذَا رَجَعْنَا " ، قَالَ : وَهُوَ يَأْبَى عَلَيْهِ ، إِذْ قَامَ رَجُلٌ مِنْ بَنِي لَيْثٍ ، يُقَالُ لَهُ : مُكَيْتِلٌ ، قَصِيرٌ مَجْمُوعٌ ، فَقَالَ : يَا رَسُولَ اللَّهِ ، وَاللَّهِ مَا وَجَدْتُ لِهَذَا الْقَتِيلِ شَبَهًا فِي غُرَّةِ الْإِسْلَامِ إِلَّا كَغَنَمٍ وَرَدَتْ فَرُمِيَتْ أَوَائِلُهَا فَنَفَرَتْ أُخْرَاهَا ، اسْنُنِ الْيَوْمَ وَغَيِّرْ غَدًا ، قَالَ : فَرَفَعَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَدَهُ ، ثُمَّ قَالَ : " بَلْ تَأْخُذُونَ الدِّيَةَ خَمْسِينَ فِي سَفَرِنَا هَذَا ، وَخَمْسِينَ إِذَا رَجَعْنَا " ، قَالَ : فَقَبِلُوا الدِّيَةَ ، ثُمَّ قَالُوا : أَيْنَ صَاحِبُكُمْ يَسْتَغْفِرْ لَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ؟ قَالَ : فَقَامَ رَجُلٌ آدَمُ ضَرْبٌ طَوِيلٌ ، عَلَيْهِ حُلَّةٌ لَهُ ، قَدْ كَانَ تَهَيَّأَ فِيهَا لِلْقَتْلِ حَتَّى جَلَسَ بَيْنَ يَدَيْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : " مَا اسْمُكَ ؟ " ، قَالَ : أَنَا مُحَلَّمُ بْنُ جَثَّامَةَ ، قَالَ : فَرَفَعَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَدَهُ ثُمَّ قَالَ : " اللَّهُمَّ لَا تَغْفِرْ لِمُحَلَّمِ بْنِ جَثَّامَةَ ، قُمْ " ، فقام وَهُوَ يَتَلَقَّى دَمْعَهُ بِفَضْلِ رِدَائِهِ ، قَالَ : فَأَمَّا نَحْنُ بَيْنَنَا فَنَقُولُ : إِنَّا نَرْجُو أَنْ يَكُونَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَدْ اسْتَغْفَرَ لَهُ ، وَأَمَّا مَا ظَهَرَ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَهَذَا.
Ziyad bin Dumrah heard Urwah bin Zubair narrate this hadith from his father and grandfather, "who participated in the Battle of Hunayn with the Prophet Muhammad (peace be upon him)," that the Prophet Muhammad (peace be upon him) led us in the Zuhr prayer and sat under the shade of a tree. Aqra’ bin Habis and Uyainah bin Hisn got up and came to the Prophet Muhammad (peace be upon him). At that time, Uyainah was demanding the blood of Amir bin Azbat Ashja’i, who was the chief of the tribe of Qais, and Aqra’ bin Habis was defending Muhallim bin Jathamah because of Handaf. Both of them began to argue in front of the Prophet Muhammad (peace be upon him). We heard the Prophet Muhammad (peace be upon him) say: "Take fifty camels of blood money from us during the journey, and take fifty more when you return." Uyainah replied, "No, by Allah, I will not accept the blood money until I inflict the same pain and grief upon the women of that man as has been inflicted upon my women." Then voices were raised, and there was much fighting and commotion. The Prophet Muhammad (peace be upon him) said, "O Uyainah, will you not accept the blood money?" Uyainah replied in the same manner, until a man from the tribe of Banu Laith, who was called Makital, stood up. He was armed and had a shield in his hand. He said, "O Messenger of Allah (peace be upon him), I do not see any example in the early days of Islam of what this killer, i.e., Muhallim, has done, except as if some goats came to a spring to drink water, and someone killed the first goat, causing the last goat to flee. So today you establish a rule, and tomorrow you abolish it." The Messenger of Allah (peace be upon him) said, "Pay fifty camels now, and fifty camels when we return to Madinah." (So he had the blood money paid by this man), and this incident occurred during the journey. Muhallim was a tall man with a wheat-colored complexion. He was sitting at the edge of the people. While the people were sitting, he made his way and sat in front of the Prophet Muhammad (peace be upon him). Tears were flowing from his eyes, and he said, "O Messenger of Allah (peace be upon him), I have committed a sin of which you have been informed. Now I repent to Allah. Please pray for my forgiveness." The Noble Messenger (peace be upon him) said, "Did you kill that man with your weapon in the early days of Islam? O Allah, do not forgive Muhallim." You said this in a loud voice. (The narrator) Abu Salamah added: Muhallim stood up after hearing this and was wiping his tears with the corner of his sheet. (The narrator) Ibn Ishaq stated that Muhallim’s people said that after this, the Prophet Muhammad (peace be upon him) did pray for his forgiveness, but outwardly maintained what he had first said, so that people would not attack one another.
