الزُّهْرِيِّ ، عَنْ
حَرَامِ بْنِ مُحَيِّصَةَ ، عَنْ
أَبِيهِ ، " أَنَّ نَاقَةً لِلْبَرَاءِ بْنِ عَازِبٍ دَخَلَتْ حَائِطَ رَجُلٍ فَأَفْسَدَتْهُ ، فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ
عَلَى أَهْلِ الْأَمْوَالِ حِفْظَهَا بِالنَّهَارِ ، وَعَلَى أَهْلِ الْمَوَاشِي حِفْظَهَا بِاللَّيْلِ " .
Haram bin Muhayyisah (narrates from his father) reports that the she-camel of Hazrat Bara’ (may Allah be pleased with him) entered a garden and caused destruction in it, so the Noble Prophet (peace and blessings be upon him) decided that during the day, the protection of the garden is the responsibility of its owners, and if at night an animal causes any damage, then the owner of the animal will be liable for that damage.
