يَزِيدُ ، أَخْبرَنَا
يَحْيَى ، أَنْ
بشَيْرِ بنِ يَسَارٍ أَخْبرَهُ ، عَنْ
رَجُلٍ مِنْ أَصْحَاب رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ
بيْعِ الثَّمَرِ بالتَّمْرِ ، وَرَخَّصَ فِي الْعَرِيَّةِ " ، قَالَ : وَالْعَرِيَّةُ : النَّخْلَةُ وَالنَّخْلَتَانِ يَشْتَرِيهِمَا الرَّجُلُ بخَرْصِهِمَا مِنَ التَّمْرِ فَيَضْمَنُهُمَا ، فَرَخَّصَ فِي ذَلِكَ.
It is narrated from a Companion (may Allah be pleased with him) that the Noble Prophet (peace and blessings be upon him) forbade selling fruit that is still on the tree in exchange for harvested fruit, except in the case of "‘araya," for which he granted a concession. The meaning of "‘araya" is that a person buys one or two trees in a garden and, in exchange, gives an estimated amount of harvested dates, and then includes those trees among his own. The Noble Prophet (peace and blessings be upon him) permitted this only in such a limited quantity.
