Hadith 21097

Hazrat Rifa’ah narrates from his father that once I was present in the service of Hazrat Umar (may Allah be pleased with him). Someone said to him that Hazrat Zaid bin Thabit (may Allah be pleased with him) is sitting in the mosque and giving fatwa to people from his own opinion regarding the person who has intercourse with his wife but does not ejaculate. Hazrat Umar (may Allah be pleased with him) said, “Go quickly and bring him to me.” When he arrived, Hazrat Umar (may Allah be pleased with him) said to him, “O enemy of your own soul! I have heard that you are sitting in the Prophet’s Mosque and giving fatwa to people from your own opinion?” Hazrat Zaid (may Allah be pleased with him) replied, “I have not done so, rather this matter was mentioned to me by my uncles in reference to the Prophet Muhammad (peace and blessings be upon him).” Hazrat Umar (may Allah be pleased with him) asked, “Which uncle?” He replied, “Hazrat Ubayy bin Ka’b (may Allah be pleased with him), and Hazrat Abu Ayyub (may Allah be pleased with him), and Hazrat Rifa’ah bin Rafi’ (may Allah be pleased with him).” Hazrat Umar (may Allah be pleased with him) turned to me and said, “What is this young man saying?” I said, “We used to do the same in the time of the Prophet Muhammad (peace and blessings be upon him).” Hazrat Umar (may Allah be pleased with him) asked, “Did you people ask the Prophet Muhammad (peace and blessings be upon him) about this?” I replied, “We used to do the same in the blessed era of the Prophet Muhammad (peace and blessings be upon him) (it was common practice).” Hazrat Umar Farooq (may Allah be pleased with him) gathered all the people, and except for two persons, Hazrat Ali Murtaza (may Allah be pleased with him) and Mu’adh bin Jabal (may Allah be pleased with him), everyone agreed that ghusl (ritual bath) becomes obligatory only in the case of ejaculation. The aforementioned two said that when one private part meets the other private part, ghusl becomes obligatory. Then Hazrat Ali (may Allah be pleased with him) said, “Amir al-Mu’minin, the wives of the Prophet (peace and blessings be upon him) would have the most knowledge about this issue, so send someone to Hazrat Hafsa (may Allah be pleased with her) and find out.” Hazrat Hafsa (may Allah be pleased with her) replied, “I have no knowledge about this.” Then a messenger was sent to Hazrat Aisha (may Allah be pleased with her), and she said, “When one private part meets the other private part, ghusl becomes obligatory.” Upon this, Hazrat Umar Farooq (may Allah be pleased with him) became very angry and said, “If I find out that anyone has done this and not performed ghusl, I will give him a severe punishment.”
