It is narrated from Hazrat Amr bin Yathrabi Zumri that I was present in that sermon of the Prophet (peace be upon him) which he delivered in the plain of Mina. Among other things, the Prophet (peace be upon him) said in this sermon that it is not lawful for any person to take his brother's wealth except with his heart's content and permission. Upon hearing this, I submitted in the presence of the Messenger (peace be upon him), "O Messenger of Allah, tell me, if I find my cousin's herd and take a goat from it, will I be sinful for that?" The Prophet (peace be upon him) replied, "If you find such a sheep that can bear a knife and a flint, then do not even touch it."

حَدَّثَنَا أَبُو عَامِرٍ حَدَّثَنَا عَبْدُ الْمَلِكِ بْنُ الْحَسَنِ يَعْنِي الْجَارِيَّ حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ أَبِي سَعِيدٍ قَالَ: سَمِعْتُ عِمَارَةَ بْنَ حَارِثَةَ الضَّمْرِيَّ يُحَدِّثُ عَنْ عَمْرِو بْنِ يَثْرِبِيٍّ الضَّمْرِيِّ قَالَ: شَهِدْتُ خُطْبَةَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِمِنًى فَكَانَ فِيمَا خَطَبَ بِهِ أَنْ قَالَ: " وَلَا يَحِلُّ لِامْرِئٍ مِنْ مَالِ أَخِيهِ إِلَّا مَا طَابَتْ بِهِ نَفْسُهُ " قَالَ: فَلَمَّا سَمِعْتُ ذَلِكَ قُلْتُ: يَا رَسُولَ اللَّهِ أَرَأَيْتَ لَوْ لَقِيتُ غَنَمَ ابْنِ عَمِّي فَأَخَذْتُ مِنْهَا شَاةً، فَاجْتَزَرْتُهَا عَلَيَّ فِي ذَلِكَ شَيْءٌ؟ قَالَ: " إِنْ لَقِيتَهَا نَعْجَةً، تَحْمِلُ شَفْرَةً وَأَزْنَادًا، فَلَا تَمَسَّهَا "
Abu ‘Amir narrated to us, ‘Abd al-Malik ibn al-Hasan—meaning al-Jariyy—narrated to us, ‘Abd al-Rahman ibn Abi Sa‘id narrated to us, he said: I heard ‘Imarah ibn Harithah al-Damri narrating from ‘Amr ibn Yathribi al-Damri, he said: I witnessed the sermon of the Prophet, peace and blessings be upon him, at Mina, and among what he preached was that he said: "It is not lawful for a man to take anything from his brother’s wealth except what his soul is content with." He said: When I heard that, I said: O Messenger of Allah, what do you think if I meet the sheep of my cousin and I take from them a sheep, and slaughter it for myself—would there be anything upon me in that? He said: "If you meet it as a ewe, carrying a blade and fire-stones, then do not touch it."
