(حديث مرفوع) حَدَّثَنَا
وَكِيعٌ ، حَدَّثَنَا
سُفْيَانُ ، عَنْ
عَمْرِو بْنِ دِينَارٍ ، قَالَ : سَمِعْتُ
ابْنَ عُمَرَ ، يَقُولُ : كُنَّا نُخَابِرُ وَلَا نَرَى بِذَلِكَ بَأْسًا حَتَّى زَعَمَ
رَافِعُ بْنُ خَدِيجٍ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنْهُ ، قَالَ
عَمْرٌو ذَكَرْتُهُ لِطَاوُسٍ ، فَقَالَ
طَاوُسٌ : قَالَ
ابْنُ عَبَّاسٍ : إِنَّمَا قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " يَمْنَحُ أَحَدُكُمْ أَخَاهُ الْأَرْضَ خَيْرٌ لَهُ مِنْ أَنْ يَأْخُذَ لَهَا خَرَاجًا مَعْلُومًا " .
Sayyiduna Ibn Umar (may Allah be pleased with him) said that we used to give land on sharecropping and did not consider there to be any harm in it. Later, Sayyiduna Rafi’ bin Khadij (may Allah be pleased with him) informed us that the Prophet (peace and blessings of Allah be upon him) forbade this. The narrator says that I mentioned this to Tawus, so he narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that the Prophet (peace and blessings of Allah be upon him) said: "It is better for any one of you to present his land to his brother as a gift than to take a fixed rent from him for it."
