حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ ، عَنْ حُسَيْنٍ الْمُعَلِّمِ ، حَدَّثَنَا عَمْرُو بْنُ شُعَيْبٍ ، حَدَّثَنِي عَمْرُو بْنُ الشَّرِيدِ ، عَنْ أَبِيهِ الشَّرِيدِ بْنِ سُوَيْدٍ ، قَالَ : قُلْتُ : يَا رَسُولَ اللَّهِ ، أَرْضٌ لَيْسَ لِأَحَدٍ فِيهَا شَرِيكٌ ، وَلَا قَسْمٌ ، إِلَّا الْجِوَارَ ؟ قَالَ : " الْجَارُ أَحَقُّ بِسَقَبِهِ مَا كَانَ " .
It is narrated from Hazrat Shureid (may Allah be pleased with him) that I submitted in the presence of the Messenger of Allah, "O Messenger of Allah! If there is a piece of land in which there is no partnership or division except with a neighbor, then what is the ruling?" The Noble Prophet (peace and blessings be upon him) said, "The neighbor has the right of pre-emption, whenever it may be."
