Hadith 18606

حَدَّثَنَا مُحَمَّدُ بْنُ مُصْعَبٍ ، حَدَّثَنَا الْأَوْزَاعِيُّ ، عَن الزُّهْرِيِّ ، عَن حَرَامِ بْنِ مُحَيِّصَةَ ، عَن الْبَرَاءِ بْنِ عَازِبٍ ، أَنَّهُ كَانَتْ لَهُ نَاقَةٌ ضَارِيَةٌ ، فَدَخَلَتْ حَائِطًا فَأَفْسَدَتْ فِيهِ ، " فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ حِفْظَ الْحَوَائِطِ بِالنَّهَارِ عَلَى أَهْلِهَا ، وَأَنَّ حِفْظَ الْمَاشِيَةِ بِاللَّيْلِ عَلَى أَهْلِهَا ، وَأَنَّ مَا أَصَابَتْ الْمَاشِيَةُ بِاللَّيْلِ ، فَهُوَ عَلَى أَهْلِهَا " .
It is narrated from Hazrat Bara’ (may Allah be pleased with him) that there was a she-camel which was very troublesome. Once, it entered a garden and caused some damage in it. The Noble Prophet (peace and blessings be upon him) gave this ruling: during the day, the protection of the garden is the responsibility of its owner, and the protection of animals at night is the responsibility of their owners. And if an animal causes any damage at night, its owner will be liable for compensation.
