حَدَّثَنَا عَفَّانُ ، حَدَّثَنَا أَبَانُ الْعَطَّارُ ، حَدَّثَنَا قَتَادَةُ ، عَنْ خَالِدِ بْنِ عُرْفُطَةَ ، عَنْ حَبِيبِ بْنِ سَالِمٍ ، وَقَالَ أَبَانُ : أَخْبَرَنَا قَتَادَةُ أَنَّهُ كَتَبَ إِلَى حَبِيبِ بْنِ سَالِمٍ فِيهِ ، فَكَتَبَ إِلَيْهِ أَنَّ رَجُلًا يُقَالُ لَهُ : عَبْدُ الرَّحْمَنِ بْنُ حُنَيْنٍ ، كَانَ يُنْبَزُ قُرْقُورًا ، رُفِعَ إِلَى النُّعْمَانِ بْنِ بَشِيرٍ وَطِئَ جَارِيَةَ امْرَأَتِهِ ، فَقَالَ : لَأَقْضِيَنَّ فِيكَ بِقَضَاءِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " إِنْ كَانَتْ أَحَلَّتْهَا لَكَ ، جَلَدْتُكَ مِئَةً ، وَإِنْ لَمْ تَكُنْ أَحَلَّتْهَا لَكَ ، رَجَمْتُك ، فَوَجَدَهَا قَدْ أَحَلَّتْهَا لَه ، فَجَلَدَهُ مِئَةً " .
Habib bin Salim (may Allah have mercy on him) says that once a man was brought to Hazrat Nu'man (may Allah be pleased with him), whose wife had made it lawful for her husband to benefit from her slave-girl. He said, "I will decide about this matter as the Prophet Muhammad (peace be upon him) would have decided. If his wife has permitted him to benefit from her slave-girl, I will give him one hundred lashes, and if she has not permitted, I will stone him to death." It was found that his wife had indeed given him permission, so he gave him one hundred lashes.
