حَدَّثَنَا
عَلِيُّ بْنُ عَاصِمٍ ، عَنْ
خَالِدٍ الْحَذَّاءِ ، عَنْ
حَبِيبِ بْنِ سَالِمٍ ، عَنِ
النُّعْمَانِ بْنِ بَشِيرٍ ، قَالَ : جَاءَتْ امْرَأَةٌ إِلَى النُّعْمَانِ بْنِ بَشِيرٍ ، فَقَالَتْ : إِنَّ زَوْجَهَا وَقَعَ عَلَى جَارِيَتِهَا ، فَقَالَ : سَأَقْضِي فِي ذَلِكَ بِقَضَاءِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ :
" إِنْ كُنْتِ أَحْلَلْتِيهَا لَهُ ، ضَرَبْتُهُ مِائَةَ سَوْطٍ ، وَإِنْ لَمْ تَكُونِي أَحْلَلْتِيهَا لَهُ ، رَجَمْتُهُ " .
Habib bin Salim (may Allah have mercy on him) says that once a man was brought to Hazrat Nu’man (may Allah be pleased with him), whose wife had made it lawful for her husband to benefit from her slave-girl. He said, “I will give the same verdict regarding this as the Prophet Muhammad (peace and blessings be upon him) did. If his wife has permitted him to benefit from her slave-girl, I will give him one hundred lashes, and if she has not permitted, I will stone him to death.” (It became known that his wife had given permission, so he gave him one hundred lashes.)
