حَدَّثَنَا يَزِيدُ ، أَخْبَرَنَا سَعِيدُ بْنُ أَبِي عَرُوبَةَ ، وَأَبُو الْعَلَاءِ ، عَنْ قَتَادَةَ ، عَنْ حَبِيبِ بْنِ سَالِمٍ ، قَالَ : رُفِعَ إِلَى النُّعْمَانِ بْنِ بَشِيرٍ رَجُلٌ أَحَلَّتْ لَهُ امْرَأَتُهُ جَارِيَتَهَا ، فَقَالَ : لَأَقْضِيَنَّ فِيهَا بِقَضِيَّةِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " لَئِنْ كَانَتْ أَحَلَّتْهَا لَهُ ، لَأَجْلِدَنَّهُ مِائَةَ جَلْدَةٍ ، وَإِنْ لَمْ تَكُنْ أَحَلَّتْهَا لَهُ ، لَأَرْجُمَنَّهُ " . قَالَ : فَوَجَدَهَا قَدْ أَحَلَّتْهَا لَهُ ، فَجَلَدَهُ مِئَةً.
Habib bin Salim (may Allah have mercy on him) says that once a man was brought to Hazrat Nu'man (may Allah be pleased with him), whose wife had made it lawful for her husband to benefit from her slave-girl. He said, "I will decide about this matter as the Prophet Muhammad (peace be upon him) would have decided. If his wife has permitted him to benefit from her slave-girl, I will give him one hundred lashes, and if she has not permitted, I will stone him to death." It was found that his wife had indeed given him permission, so he gave him one hundred lashes.
