Hadith 18149

حَدَّثَنَا عَفَّانُ ، حَدَّثَنَا شُعْبَةُ ، قَالَ : مَنْصُورٌ أَخْبَرَنِي ، قَالَ : سَمِعْتُ إِبْرَاهِيمَ يُحَدِّثُ ، عَنْ عُبَيْدِ بْنِ نُضَيْلَةَ ، عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ ، أَنَّ امْرَأَتَيْنِ كَانَتَا تَحْتَ رَجُلٍ ، فَغَارَتَا ، فَضَرَبَتْهَا بِعَمُودِ فُسْطَاطٍ ، فَقَتَلَتْهَا ، فَاخْتَصَمُوا إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ أَحَدُهُمَا : يَا رَسُولَ اللَّهِ ، كَيْفَ نَدِي مَنْ لَا أَكَلَ ، وَلَا شَرِبَ ، وَلَا صَاحَ فَاسْتَهَلَّ ؟ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " أَسَجْعٌ كَسَجْعِ الْأَعْرَابِ ؟ " قَالَ : " فَقَضَى فِيهِ غُرَّةً " . قَالَ : وَجَعَلَهُ عَلَى عَاقِلَةِ الْمَرْأَة .
It is narrated from Hazrat Mughirah (may Allah be pleased with him) that two women had a fight, and one of them killed the other by striking her with a tent pole. The Prophet Muhammad (peace and blessings be upon him) ruled that the blood money (diyah) should be paid by the male relatives ('asaba) of the killer, and for the loss of the unborn child in her womb, he ruled for a male or female slave as compensation. A Bedouin said, "You impose compensation on me for a life that neither ate nor drank, neither cried nor moved; such a life is usually overlooked." The Prophet Muhammad (peace and blessings be upon him) said, "This is the kind of rhymed speech Bedouins use, but the ruling remains that for the loss of that child, the compensation is a male or female slave."
